WON - Case Dismissed by DDJ! One Parking Solution Vantage Point Brighton - £95 Costs Awarded!

It doesn't specify. It was sent in Oct last year and said it would be heard remotely, but I've received nothing yet confirming. I rang the court info line and they gave lpgger my call as "urgent" and flagged up for the court to contact me ASAP. They've confirmed receipt of my WS/ other docs.Le_Kirk said:
What does your notice of allocation say abut the hearing; F2F or video call? You are right to contact the court to find out the procedures and test the link.
I never even got an acknowledgement from DCBL (or the parking company) after sending my Supp WS. They were usually quite smug and condescending and I'm surprised they've missed an obvious last minute opportunity to attempt gaslight or rubbish my further claims - which is something they previously seemed to relish.🤔
I've heard absolutely nothing - I'll most likely turn up in person with my laptop/ paperwork bundle if I hear nothing the evening before. It is still listed as going ahead. Although I would of thought someone would have got in touch or I'd at least heard some sort of confirmation as it's later this week.

Well done, you deserved the win.
So DCBL passed the buck to ELMS ?? In reality, who did you spank in court ?
 IT WAS .......... OPS ..... DCBL .... ELMS ? ....... BRAVO4

My experience with these legals reminds me of a kids toy with a wind up key in their back and when the motor stops .... so do they ?95Rollers said:
Thanks @pat@patient_dream - It was ELMS I believe - the reps first name was Tom and his surname is the name of a car-deirved truck (what the Australian's would call a "ute") as we cannot put people's names on here and to be fair he was a nice enough chap, but was clutching at straws repeating a lot of stuff over and over.patient_dream said:Well done, you deserved the win.

I believe the case number was H6KF427M.
The 'KF' in the number indicates that this was originally filed by DCB Legal on behalf of OPS.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.5

That is correct. DCBL were the firm who filed the claim and did the WS and Supp WS. But a quick LinkedIn search said that the guy works or had worked for Elms - maybe he's freelance? Anyhow they've wasted a lot of money trying their arm at this:
 £52 court fees
 £95 payable to me
£??? whatever the rep cost them
£??? whatever DCBL charged them for their 3 crappy copy & pasted template statements
£??? x amount of hours at UK minimum wage for their staff to process my SARs, admin and all that "work that takes them away from their usual nature of business" etc
 £££ stationary/ mailing/ paper/ printer ink etc.
 £££ on utilities like electric
I'm happy that justice and common- sense prevailed after a 3 year headache which I can finally let go of. But I'll still be on here to assist others. They picked the wrong person to pick on 7 7

            Brilliant news!
The industry as a whole are still smarting from picking fights with the wrong people - join the club!
I've been discussing your case with @ParkingMad behind the scenes as we are both in the BMPA off-forum fightback association and she likes a good OPS case as much as the next woman (me). I know she reached out and advised you well.
Honest people of Sussex opinion - matching that of local Councillors and journalists, and of course the good people of Llangrannog in Wales - might say that OPS need to get the heck out of car parks and go back to their old day jobs.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well done. I thought that you would win. You have spent the time to get your head around the issues.
It's quite expensive for these parking companies to take a motorist to court. I think that Elms charge around £125.00 plus Vat per hour. That was the cost of the rep at my hearing £250.00 plus Vat for 2 hours but that has been several years ago. They have to pay whatever time has been allocated to the case even if the hearing only lasts 10 minutes.

That's good because you now have experience that some of the regulars don't have (you've been to a hearing and WON) and can help others from a personal point of view.95Rollers said:I'm happy that justice and common- sense prevailed after a 3 year headache which I can finally let go of.
