Some years ago I disputed an energy bill which ulimately was passed to a debt collection agent. I told them that the debt was disputed and they passed it back to the energy company. In the meantime I contacted the CEO and they tried to avoid an Ombudsman complaint. Too little too late for Snakes and I took it to the Ombudsman. Claim was wiped and I was awarded £100.00.
What the debt collectors and the PPC's don't seem to understand is that it not just about affordability. I would have sooner given £100.00 to the first beggar in the street than pay it to Excel. People will give generously to people who are in need but they don't like being scammed and it becomes a matter of principle.

This is one of my gripes. Along with my friends and family members and myself, every one of us said DCAs should be FCA regulated. It is my personal opinion that the government/dept for levelling up were yet again hoodwinked by the parking industry because instead, the new CoP merely states DCAs must be a member of an ATA.

The reason why they are not regulated by the FCA, is because the FCA only has jurisdiction over regulated debts, for example Credit Card Agreements which are subject to the Consumer Credit Act 1974.
Parking charges are not 'debts' in any legal sense, unless and until a Judge in a County Court rules that they are.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. But let's be thankful something changed the minds of the DLUHC about the fees. And I am not letting on what I believe that 'something' was.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As we all know then are not legally classified Debts then surely something be can done about them falsely claiming that these charges are "Debts" they used terms like "You Owe us/ your debt/ current outstanding debt balance" etc on letters so surely this amounts to making a false representation?!? They are making this false representation to get money off people and cheat them out of a fair right to appeal or contest in court.4

Let' take the comments by the the MD of DCBL ....

What was discussed was about debt collection and myself along with countless others said that such charges were not in line with the charge and should not be allowed
It was the DLUHC who BANNED these charges after representations by the public and those on this forum
BANNED .... not SCRAPPING ,,,,,,, this will create a problem for DCBLand the rest who apply a scam charge
Then in the article DRP speaks out ...... what a load of tosh ... more idiotic propaganda to brainwash the parking operators.
Who started all the fake rubbish ? ZZPS did and the BPA fell for it, hook, line and sinker. So much so that the BPA added it in their 2018 code of practice
The BPA looked no further than the end of their nose and now it's bum biting time
