Least your getting something now. You got diddly squat before.  Did you appeal the 50% rule then ?

No we didn't appeal the 50% rule because we knew we wouldn't get anywhere as thousands in same boat.

However I am yet to discover someone in thus scenario which I why I posted this in the first place.

You are probably highly likely correct that appealing will get us nowhere but if we don't give it a shot I will always be asking myself what if.

When I spoke to the HMRC guy today he agreed that it didn't sound right hence telling me to appeal it after speaking with his team leader.

With all due respect, the people on the front line are hardly experts in this.  It's also par for the course in front line customer service to basically agree with the customer and tell them to write in/appeal rather than telling the customer to suck it up.  There is little to be gained by them telling the customer how it is, outside of an hour-long argument and "I want to speak to a manager"

Some people know it by another term "fobbing off."

This has happened to my husband too. He wasn't eligible previously cos of the 50% rule.

Hes eligible for the 4th grant but as they take the previous year into account, hes getting a smaller grant than if they only look at the last year.

We'd rather they didn't do it this way, as like  the OP, we felt it was a bit harsh to include the previous year. But it is the rules. Any help is appreciated and it is better than nothing.

We've accepted the grant and won't be appealing, as I think that would just get our hopes up for no reason.

I welcome to hear news of anyone else in a similar scenario to us, and hope that you will appeal it heavily, which is what we will be doing.
You have no grounds for appeal, the grant will be processed in compliance with the relevant act of parliament. You would only have grounds for appeal if they grant was not in line with the legislation.
Then why would HMRC tell me to write in to appeal it?
Appreciate this won't be of any comfort but it got you off the phone.  Job done for that adviser.

Someone else will now have to reply to your "appeal" explaining why nothing will change.
  • I've got a similar query. Went self employed end of 2018. Didn't earn over 1k so didn't complete a tax return in 2019, but I did inform HMRC of my total earnings for child tax credits purposes. Business started going well and I had a good year 2019/2020. I'm now entitled to the 4th grant due to completing the latest tax return. I'm wondering if they'll only use the figures from my latest tax return or use the figure I submitted for child tax credits as well. I can apply Thursday so I suppose I'll find out. It will drag down my average horrendously!

To be fair, the appeal process will likely consist of 30 seconds reading the OP's appeal, then selecting the correct reject reason and moving on.  Probably done and dusted in less than a minute.

Far less time than it'd take to convince the OP over the phone that their calculation is correct.

This is a very interesting one, as another poster has complained that their not completing a form SA103 for 2019/20 for exactly this reason led to their claim for SEISS 4 being rejected. There is a fair chance that HMRC will just look at your 2019/20 figure. Keep your fingers crossed.

Thanks, I've not come across anybody with a similar situation in my research. I can claim on Thursday so let's see. It'll be a difference of thousands so I'm keeping my fingers tightly crossed. I've always been very honest, worked hard to build it up, so it'll be nice to finally get some help!

Because they are humouring you so you don't take the hump and letting someone else deal with you. They have the rules and they will follow them. If you actually want to change them contact your MP.
