My wife's pension provider asked for a copy of if along with all the certificates. There has been no progress yet after I returned the email with all the info they asked for i.e details of my wife's parents and my parents who are named in the will as guardians only if both of us died and there was no one to look after our sons. I suppose its a waiting game now to see what there decision is. The defined pension in question is from an old employer that she no longer worked for and it only has a modest amount in the fund. Fortunately she went to work for the NHS a few years before she died and I can honestly say that they have been absolutely fantastic, they never once asked to see a will or about any parents etc, the whole matter of my wife's NHS pension was sorted out for us within 2 months but the small private pension company has been utterly terrible and I feel like they look at me as someone not to be trusted it's terrible. Made more so by the fact that my wife and our two sons have always been a very quiet private loving family and to think that one of her small pensions can be divided up between extended family members outside our direct family is utterly disgusting considering that they asked to see the will and since I have discovered that the pension is outside the remit of a will. To me it is so ridiculous to consider giving any of it to our parents that it makes me feel like I am entitled to a share of both our parents pensions because if it is all because they are named on our will as potential guardians in the case of both of us passing away and leaving our sons in need of care I am named on our parents wills as executor so because I am 'named' on their wills I think this entitles me to claim their pensions??:) Do you see my point of view and how stupid and twisted it seems to me? Please forgive me for rambling on but the longer this goes on for and the longer that the particular pension provider drags their feet the more and more stressed I become. Arrghhh!

That is my point precisely. Potential Guardians only in the case that both parents die leaving two minors dependant. I am alive still and thus the people named as 'Potential Guardians' do not come into any financial decisions unless I am dead.getmore4less said:

When my husband died his will named me to receive his estate. I was also named as beneficiary for his pension.
However, the pension company explained that they are required by law to establish who should inherit the pension.
I had to complete a form giving details of my two sons (who were in their 40's ) for them to establish that my sons had not been dependent on my husband.
They may have decided that due to the ages of the children they should inherit the money.
They seem to think that the parents are guardians for the children.
The problem may be the wording in your wife's will as to when the parents take over guardianship.0 -
