I reckon that for some of these

    1. They take a view and don't bother turning up for the weaker ones and take pot luck

    2. That in others they are gambling that 1 advocate can do several back to back by video. In essence, a calculated risk to use fewer advocates, but if one runs over time, then they cannot join the next hearing.

The o/p should deffo hang onto the papers.  Judges rarely offer up costs, so forumites do need to be proactive. In this type of case if they want them.

    * they've wasted court resources by not turning up to trial
    * dragged out an unmeritorious claim for months (here where the op essentially didn't park at all)

In any case, congratulations! Also kudos for the beautifully prepared images as marked up.

Well I thought this had all gone away after the judge struck out all charges at the hearing.

I came home to a letter from BW Legal offering me a payment plan before the case went to trial. I assumed it was just a admin error but emailed the court just in case.

Apparently the case has been relisted and I will have another hearing! How is this possible if the judge struck out all charges? Any advise on where to go from here?

    Thanks.

Did you get through the post the court order striking out the claim?

Perhaps they appealed the judgment and the case has been relisted for appeal?

Have you received anything via post from the court regarding this relisting?

They will have proved it was court error in not phoning them for the hearing.  So it all rewinds.  You did ask the court for the directions letter about the hearing?

No I hadn't received anything from the court. The judge said he was striking out the claim. I asked him if I needed to do anything else to which he said no so I assumed it was all over and done with.

I've had absolutely nothing from the court since the hearing in November.

I would suggest that you follow the above advice from coupon mad and ask the court for a directions letter , by post , on paper

And ask them to email you a copy too (so you get it quicker, and in case there are any COVID-related postal issues such as there are around my way).

I've just received the Notice of Adjourned Hearing from the court. It states that the claimant's representative changed their contact details at 1045 when the hearing was at 1200 but the court did not get a notification of this until 1220. Doesn't seem fair really considering they strictly state all the details need to be submitted 7 days before.

Should I still request a directions letter?

Will I need to resubmit my witness statement to both the court and BWL?

    Thanks all.
