    @beamerguy

    hi Beamerguy, and all.

I have received these letters on the 20th July, following this post I have made.

Can I please get advise how to respond back with these letters as I have never been in a situation like this before and don’t want to make any silly mistakes….

Many thanks for you’re help and I hope to win this battle.

That’s not a letter it’s a claim form and the NEWBIES thread tells everyone what to do.  If you were not expecting that and didn’t know what a claim form looked like, you really need to read more threads and come off this little one.

People who only stay on their own threads on this forum are more likely to lose or miss a court deadline. This is why the NEWBIES thread exists. No poster has been in this situation before.

All cases are like this and it is worrying you don’t seem to have read anything on this forum, except excitable replies on your own little island of a thread.

With a Claim Issue Date of 20th July, you have until Monday 9th August to file an Acknowledgment of Service, but there is nothing to be gained by delaying it.
To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an AoS, you have until 4pm on Monday 23rd August 2021 to file your Defence.
That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

With two and a half grand at stake it’s extremely worrying to see a poster has been here months yet not read post #2 of the NEWBIES thread yet (or only read the LBC section and stopped reading?) nor the Template Defence thread.

The very first reply you got told you to take it seriously and what to read to prepare for this claim:

With 13 tickets and a potential claim for £2,100 you need to deal with this correctly and in a timely fashion. Please go to the NEWBIES FAQ sticky, second post..
If you were getting tickets every time the vehicle was parked at the location, why did you continue racking them up?  A question that no doubt a Judge will want an answer to!

YES, you must get to grips with this now and carefully listen to the advice.

13 parking tickets will be valued at "£1,300 MAX."
£2,393 will contain fake add-ons.    That is the first problem for CST .... FAKERY

The next problem is Jackie McGuirk who signed the claim as a STATEMENT OF TRUTH

On the 24th Feb 2020 the law says that the statement of truth should read as follows

    https://www.dacbeachcroft.com/en/gb/articles/2020/march/amendments-to-the-civil-procedure-rules-bring-mandatory-changes-to-statements-of-truth/

[I believe] [The party believes] that the facts stated in this [name of document] are true.  I  understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.

ARE THEY TRUE ... IF FAKES ARE ADDED IT'S NOT TRUE

NOW you require a breakdown of £2.393

Remember a false signed statement could lead to contempt of court for the claimant

The OP has a court claim and doesn’t need a breakdown of the false costs.

It’s not a contempt of court.  Now, he/she should be showing us their draft defence points 2 and 3, having read the threads we’ve pointed them to read.

Am aware it is a court claim. Of course the OP needs a breakdown
You know that the fakes have been added and of course the civil procedure comes in to force.

Thank you Beamer Guy for your advise, can I ask you off subject in this situation can I make a counter claim and if so, how much. I actually left the company where the vehicle was used and have been very stressed due to this whole situation. All I was doing at the time was loading and unloading for the office.

If this was me, I would go the company where you loaded and unloaded and show them this claim.
Try to get a letter from them that you were doing your job.
If they employed the PPC you can ask them to arrange cancellation as the PPC was interfering with your work.
Involve the company even suggest that you will call them as a witness in court

Counterclaims are not easy and could be costly
