  • That's what I was thinking! Doesn't matter if it was a brand new pram or one that she was gonna chuck out , it was still her property!

I remember a mum at the school saying how she had a pram ruined by an Asda delivery van, she had left her pram on her drive while she took the baby inside and the delivery man who had been delivery next door decided to reverse on her drive to get out, he hit the pram and then dragged it half way down the road, Asda sent her a top of the range pram and vouchers for nappies and wipes worth £200. She never mentioned to Asda that the pram was one she had had for 6 years and was going to throw away and buy a new one lol.

Good luck OP, people have no right to damage your property, shame you couldnt do him for trespass lol.

The original poster can sue for tresspass as the property has been damaged. ;)
Wow, I got 3 *, when did that happen :j:T:p

I would expect Asda to pay however for someone to come out and fix your lawn .. plus a few vouchers as a gesture of goodwill should more than make up for a ruined breakfast and soggy boyfriend ;) Hopefully you kept a note of his registration .. did the van driver not offer any advice on what to do or an apology? Ivan

Even if you haven't got the reg number all van drivers have a sheet that lists all their deliveries for the run, and they have to keep them in-store for about a year, so they should be able to look back through that days sheets and find out who the driver was.

Come on guys a little bit of perspective here ... suing for trespass is getting a bit silly

I don't care about your first world problems; I have enough of my own!
  • It depends on the amount of damage done and the cost to replace it :) But lawyers are hungry for all fights. :)

There's probably an implied permission to access your driveway or path up to the door anyway, but trespass aside you should be compensated for the damage caused.

I would either phone the local store or even better go down there armed with photos and ask to speak to the HOME SHOPPING manager they will then sort all this out. Pretty sure Asda have insurance for this kind of thing anyway.

But also state that you helped and would like a hamper ;)
  • I think the solution here would be for Asda to offer you free shopping and free delivery upto the value of £20. I have fully understood the post above now!

I would be pushing for them to pay to have it re turfed if need be, I certainly would not be happy about having a muddy patch and ruts in the front lawn due to the incompetence, or laziness of their employee.

It's certainly not unreasonable, and is the minimum I would settle for, as has already been said they will have insurance to cover damage caused by drivers whilst on the job, and a very basic principle of insurance is to attempt to put things right (either repair, or proper compensation), especially when the owner of the damaged property is not the one at fault.

£20 worth of vouchers (in reality about a £10 cost to the store) wouldn't amuse me*, as it's something that is going to either cost a reasonable bit of time and money to put right quickly, or several months if you go the cheap fix (especially at this time of year when you can't even sow the seed for another few months).
I don't even think Asda do grass seed :p

*Assuming I charge at minimum wage, I suspect it wouldn't cover my time in preparing the ground and laying the seeds and the cost of the seeds and fertiliser/lawn feed etc whilst it regrows.
  • Little bit late to this one, but as a driver myself, if I did something like that I'd half expect the sack.

I've pulled a supermarket delivery driver out of a grass verge myself in the past, we met on a single track road and he drove straight on the verge to pass me and got stuck. Lucky for him my motor was bigger and I hung around after I'd passed him, as I thought he might get stuck.

I know somebody who drives for Asda as well and I don't think a massively high standard is required.;)
