Declaring a noise complaint

Hello, I have decided to sell my rental property. I’ve been waiting for my tenants to give notice, which they have,  but they have also made a complaint to the council about the neighbour and about her being noisy and difficult. It’s the first complaint  someone has made about her and I assume that it won’t  be pursued if my tenants move out.  Will I need to declare it if I sell- and will this impact on my ability to sell at all?

    Yes you should declare it.  It is within your knowledge
    Whether it will impact you will depend if the potential buyer cares enough.  Every buyer is different. what some may consider noisy, another person may not.    Once you declare it, it's up to the buyer to do their own investigations.

    I have never known anyone to declare dispute with neighbours has it will put most buyers off. Good old British traditions long gone unfortunately.

    I would report that you understand this particular tenant had some unresolved disagreement with the neighbour and leave it at that. People will infer that other tenants didn't have any problems.
  • Yes and in another thread on here someone found out about a dispute that wasn't declared and everyone said tough, there's nothing you can really do about it. So what's the point of declaring anything!

    That's about as likely to work as Bozzer is of leading this country with integrity.

    Here is the question from the TA6 (May 2020):

    2.1 Have there been any disputes or complaints regarding this property or a property nearby?

    There has been a complaint. You are aware of it. You must answer yes to the question. 

    Of course you could answer no but that would be a deception, which could be bad for you if your eventual buyer has a problem and manages to prove that there was a complaint that you knew about.

    Because of course any noise complaints are reported to the local council so it may come up when the local authority search is done.  
    Noise is a big issue for some - particularly those at home all day due to homeworking, being elderly etc - and less for others who are out and about a lot more. Of course if the noise is at 2am every weekday that would be off putting!
    For me the neighbours are almost as important as the house - would rather live in a hovel where I had peace and quiet than nicer property where you cannot sleep as the neighbours play loud music all night most nights, commit anti social behaviour, have unruly screeching kids and more.
    Perhaps the best thing would be to establish what the noise issues were - so you are prepared and know how serious they were!
