  • I have obviously left this too late so will just submit it as it is, assuming it will be awarded in the claimants favour...... I have covered all the incorrect points in their WS and made reference to the blurry photos they have provided to the court yet to me they have provided crisp clear photos which contain nothing but members of the public.

    I referenced that they have clearly copied and pasted general information as they are still referring even in the witness statement of the driver of the vehicle going into another store, where it was the passenger and that the driver never left the driver seat. They actually highlight a sentence which says about this and answer it with generic text about the sign being a contract once the driver leaves the seat.

    Which lady on the phone?  On  one of your posts earlier you could not find the letter; have you now found it?
    The lady at the court, and they re-sent the letter which arrived today (45 mins ago).
  • I can post a redacted statement but like I say, I've f'd this up too much going on here the money isn't even the issue to me to be honest. Its just the !!!!!! take company being totally wrong. Shall I post the redacted document here, I recon I have about an hour and a half for amends before I submit it.

    Either option seems to be accepted at the moment.
  • OK sent - I left in the bits which were correct (the signature not being witnessed on the silly agreement they sent me) etc, should I remove the draft now as its pointless for review given its way too late cause I f'd it up? 

    How bad is it ?

    What's done is done ... at least you sent it on time (before 4pm). Did you get any form of acknowledgement (e.g. an auto-response)?

    Did you also send a copy to the Claimant('s legal company)? If you haven't then send that email NOW! (It is suggested to file with the court and serve on the other party using the same email).

    BTW the clue that your WS was due was the fact that you'd received the Claimant's WS. ;)

  • Lol, yeah, I did think it was weird it was early... Yes I sent it and got a auto response, also copied in the paralegal which sent it over to the court in the same email.

    They said in theirs that they copied me in, then didn't and sent it to the court then forwarded it over to me...!

    I am quite confident on it - hopefully, but as you say what's done is done, the money isn't the issue. I would actually pay in excess of what they want for them to not get it from me.

    That WS looks fine.  The only concern is if the Judge thinks those signs are pretty clear.  If so, it can be hard to win but at least you've covered the added £60 rubbish.
