To my knowledge (which isn't vast) yours is the first Directions hearing we've encountered which has resulted in a judgment (assuming that's what it is - the letter will clarify).Jenni x3 -

If I was to pay the CCJ as soon as it comes through the door, would I still be able to further spend money down the appeals process or does it not work like that? I kind of think I should pay for a transcript and approach an actual solicitor firm for their legal views. I would sleep better loosing more than paying this.
Is there a rough cost of 'words' for a '47 minute' hearing that was around an hour and 20 minutes late for the transcript? e.g. what would be the approx costs for this as its based on words and typically X words in a 47 minute session.0 -

I think a short transcript like that would be about £100 (off the top of my head) but you can only appeal if the judge 'erred in law'.

I am not agreeing with his decision but you do get a few pro-PPC bad Judges and a few people each year on this forum do lose their cases, if the Judge thinks the driver had a fair opportunity to get out and read the terms.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As the Judge didn't grant leave to appeal, you would have to apply on form N164 to the Circuit Judge, for leave to appeal. Your application must state the grounds of your appeal, which must fall under one of three headings:
a) That the Judge erred in law;
b) That the Judge made a finding of fact that no other reasonable Judge would have made on the evidence;
C0 That the Judge made a procedural error in the way the hearing was conducted.
The application fee is £120, and the Circuit Judge will decide on the papers whether to grant leave to appeal. If he does, you will then need a transcript of the first hearing, which costs about £200 of court time, and a skeleton for the appeal hearing.
Looking at the details, preliminary hearings can turn into final hearings if the Judge decides that the Claimant or Defendant has a hopeless case. In your case, the car was parked in a Co-Op bay, and neither the driver nor the passenger shopped in the Co-Op. It doesn't really matter which one got out of the car.
Circuit Judges are notoriously more pro-PPC than District Judges. The chances of an appeal succeeding are, IMHO, as thin as the low-fat spread on an anorexic supermodel's crispbread. Don't throw good money after bad.
