  • I am working on the WS today. I have gone and got covid so that caused more delay! The court said that there isnt a timeframe between but anything to be relied upon should not be before 7 days so I have until next Monday to submit it.

    Today I got a letter from BWLegal saying they will not attend the hearing and the judge should decide in their absence. 

    They also sent a skeleton argument on behalf of the clamant and the first point says its a copy and paste from moneysavingexpert.com lol.

    They go on in this document to say that no contract acceptance was required because the car park was entered, there is no car park it is bays on the side of a road....

    I can post it here but its quite long and possible that its been posted before?

    It's a typical letter , seen numerous times before , just get on with your WS and get if filed asap , because next Monday is a bank holiday , meaning that court is shut !!

    Assume that you must submit it by this Thursday , preferably by email to both parties , covid won't stop that from happening

    They may use an advocate for the hearing , it's what usually happens
  • They actually are referencing parts of the defence in this doucment, can my WS refer to points here to again back up what they are saying is untrue? They are still saying that the driver left the car when in fact it was the passenger, showing that they actually haven't read the defence.

  • In their WS they state again that the driver got out the car and this just isnt true, can I reference this directly in my WS or just state these facts which are against theirs?

    Yes , criticise anything you like in their WS and claim , if you don't it may be assumed that you agree with it !!  So definitely refute anything incorrect or dubious , highlight the errors especially

    Their witness statement should really back up their claim , but they like to rubbish the opposition instead , so rubbish their rubbish 🤔🤔😋😋
  • So I can literally say As per the Claimants Witness statement point 15.3 and 15.4 both of these statements are incorrect as previously stated in the defence and appeals process?

    If it's true , then yes , fight fire with fire , no need to ask , just do , feel free , it's your personal statement , no template , it's a bespoke , truthful , signed statement , so why not ?? Fill your boots !  🤔🤔😋😋😋

    Which lady on the phone?  On  one of your posts earlier 11 December at 7:49PM you could not find the letter; have you now found it?
