They end by saying as a gesture of goodwill they will reduce the CN to £20 if paid before April 30th after which point it will revert to £100.If you're prepared to do all the research and work to beat this, including the probability of a court claim being issued (any time in the next 6 years, about which you'll have no idea until it drops through your letterbox), ignore the 'gesture of goodwill' - but be aware, it's no longer about £20, £100 comes permanently into play. It's your choice entirely, but sometimes pragmatism is an alternative to principle. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Personally. if I fancied my chances in court, I would not pay them a penny.

You need to think carefully about this ..... for a start, who is telling Excel that you were the driver or is Excel fabricating this ?
Given the poor service by Iceland, you should bring this to the attention of the Iceland CEO.
If you google CEO email address, Iceland" you will find his email address.
Excel would not make that offer unless they were unsure themselves. Paying Excel £20 would not even cover their costs on this so Excel will be the loser.
You have until the 30th to decide. If you issue your complaint to the CEO of Iceland today requesting urgent action with a request for him to cancel this charge
You will never know until you ask.
Excel will have to also think about this as it could be costly for them with a court case especially when you can claim costs3 -

I still don't get how an internal complain to Iceland regarding this, that they'd discuss with their property team, ended up going to Excel instead. Unless they meant that was their property team in. I. Which case are they allowed to share my data to 3rd parties without my consent?
I have tried contacting Malcom Walker, the CEO, but his email bounced back. Ended up emailing the other CEO called Tarsem Dhaliwal a few days ago outlining the whole complaint. No response yet and no acknowledgement of receipt of the email either.1 -

The thing is that you are unlikely to get any costs at present if you win as judges don't seem to award costs for telephone/skype hearings.
You will also have to produce a defence and WS and send these to the Court and the Claimant. There is no guarantee of the outcome in the DJ lottery.
I think that in this case (much as I dislike this company) I would pay the £20.00. They will still be the biggest loser.

I would consider paying the £20 then complain MUCH more to Iceland and tell them you are £20 down and your data was compromised (not only shared with Excel without permission, but someone also told Excel that you were driving when this was never stated and the opposite was made clear in the complaint).
Ask what are Iceland going to do about this to resolve it because you are minded to report them to the Information Commissioner and are far from happy about their choice of contractor and how they harass and bully people, as well as being livid about what they told Excel.
Do they realise they are using a notorious ex-clamper, etc, etc: (some links here from an aggrieved person):

"Thank you for your email. Your complaint has been passed to me to review as part of Iceland’s Executive Resolutions Team. I’m really sorry to hear of the problems you have had regarding you parking fine and for the upset this may have caused. We have been in contact with Excel requesting for them to cancel your parking fine, Excel have responded to us and want to resolve your complaint, they have requested for you to contact their Appeals Department directly so they can reach a resolution with you.If you require any further assistance with this matter, please do not hesitate to contact me.Best wishes,"
Should I
1) contact Excel as they request,
2) go back to Iceland and ask them to sort it out themselves,
3) pay and ask for a refund,
4) or something else all together
Thanks everyone.0 -
