Hi-- Just thought I would drop on here and give you an update on my case and my court experience.
I won
The judge dismissed the claim on my first point which was the authority that the Claimant had to enforce the parking rules. The judge said that the evidence looked like a personal address, was a shoddy letter with careless drafting and didn't identify the location. Not only that, the judge said that in BW Legal's WS, the solicitor knowingly made a false statement with an intention to deceive the court in attaching as evidence an agreement-- which was being passed off an agreement. Because of this I was awarded costs for loss of earnings and additional costs due to the Solicitors having behaved unreasonably.
