    He doesn't need CMS to get a birth certificate. As mentioned upthread, anyone can apply for anyone's birth certificate from the General Register Office for £11. This should be his first action before consulting solicitors. As several people has said, an unmarried father cannot have his name on the certificate unless he goes to the register office. If someone else went and forged his signature, that is a criminal offence
