Thank you all for the advice, I will make a formal complaint to the SRA,

On the day when the Judge made the decision the Lady representing BW Legal asked to appeal the decision and he just said he was refusing her appeal so how official that is I'm not sure.

Its a new claim form with a new reference No. etc so I guess they have failed to notice that the case was already settled in court and since submitting my defence I've received a letter from them say the following "The purpose of this letter is to inform you that our client intends to proceed with the matter notwithstanding you reasons for disputing the claim." and how they feel they will win etc so I guess they didn't even read my defence about how its already been to court?

I can see the reluctance to spend money on an application, even if it seems all too likely that the o/p would get it back.

Have you a copy of the old claim form and the old judgment? If so, I might send them in, whilst making some pointed remarks with the directions questionnaire in the hope that the court does what's needed.

No need to wait for a DQ. You can get one online and lodge it, now that à defence has gone in.

@Co_Avalon - @Johnersh is a legal professional, and one of the most knowledgeable posters on this board: I'd definitely be following his advice.
