Can I be taken to court twice for the same Parking Ticket?

Hi, 
I received a Parking Ticket back in 2017 and followed the steps set out in the Newbies thread, went to court in 2019 and won the case with the Claimant having to pay for my costs which they did. Then mid 2020 I started getting the letters from them again trying to claim for the same parking ticket. I have now had a County Court Business Centre Claim form arrive. I replied to this claim stating that the Claim had already been settled in court and provided them with the original Claim No. but they are insisting that they will still be taking me to court again.
Can they take you back to court over the same parking ticket?

    Are you saying that you have filed a Defence to the current Claim?
    If so, please show us exactly what you filed.

    And to answer your question... no of course you can't be tried twice for the incident.

    I wish you'd come here before firing off a defence, because surely the obvious thing to have done (too late now) was to counterclaim for a few hundred quid for harassment and data abuse, because they've stored and re-used DVLA data with no reasonable cause.

  • Thanks for your reply, yes in my defence I stated the following:

    I am Disputing this claim as it was originally filed for under the Claim No. ----------.

    For this original Claim I have already been to court and won the case back in 2019 the judge also refused their appeal on the day.

    There for I see no reason why I am now receiving letters and Claim forms trying to once again get payment that is not due.

    I hope you are right that this is the same PCN, is all I can add.  I so wish you'd come here because if you are correct you could have filed a counterclaim.

    As above you cant be done twice for the same incident, however they can try as much as they want as anyone can dig themselves into a deep hole.
    Your previous case and result should form part of your defence, i would also look at things such as claims for unreasonable behaviour, misuse of personal data and claiming ful costs - again.
     make sure that you keep a timesheet showing exactly how much time this is taking, also take a note of any stress/inconveinince this is causing things such as disturbed nights sleep and so on

    I understand that and I really considered making a counterclaim but figured I'm more trying to avoid having to go to court at all at the moment.
