Whos car park was this??I would also be going after the car park owner/landowner as well, the only exception would be if the car park belongs to a small independent trader, or a community group - if its a small independent trader then you should inform them of this - together with the risk they are putting themselves under due to practices such as this.And if a community group ( ie village hall/sports club etc run by a committee) you should make them aware that they/the trustees could be liable - most committees are scared of their own shadow ( and some meetings can be worse than Handforth parish council) so small business or community group make aware.Big corporates with legal departments etc should on the other hand know betterFrom the Plain Language Commission:

One question I would ask ..... BWLegal lost the first case, did they appeal that case as they do sometimes ?
I would phone the court to ask the question.
If not then this is sheer incompetence by BWLegal and unreasonable behaviour and your costs claim must reflect this.
A severe complaint to the SRA must be done

Why avoid court when you, and the judge could give them a hiding. Write to the SRA

asking if they condone such behaviour, and complain to your MP.
You never know how far you can go until you go too far.1 -
You could make a formal Applicaiton (£100 cost that you reclaim) toi have this claim dismissed now
You would provide evidence of the previouis claim being won by you, possibly the order of judgment if you still have it, and alongside the order you would claim costs of app PLUS your costs of making the applicaiton in your time
There is zero costs protection for the claimant right now, as the claim has not yet been allocated - I presume?

It does however appear that this is incompetence by BWLegal and as such, action should be taken2 -
If it were appealed, the D would have been informed,. and it certainly could not be a NEW claim form.2

As far as I am aware, an appeal can still be made even if the judge of the original case denies the claimant the right to appeal. I'm not sure how this works though.I married my cousin. Absolutely this can happen. but they would have been obliged to inform the D that an appeal was lodged, and even if the appeal was successful, it would NOT result in a new claim form being sent!3
