Question on insurance when renting.

My friend rents a flat and his bath has split. He didn't break it it's just down to old age. He spoke to his letting agent who got in touch with landlord who has said they aren't going to repair the bath as he broke it. They haven't even seen the split.
Anyway he has now taped the split its about an inch and a half above the plug and showering in the bath. He's not having baths as he knows it will leak.
So the question if over time water leaks down into the flat below who is liable? Is it landlord as its their building. Or is it friends fault as he is using bath that he knows is faulty?

The Landlord is fully responsible for replacement of the bath. Suggest that your friend writes to the LA/LL stating when the damage occurred and how and requesting a date when it will be corrected by.
See what happens and come back to this thread with the answer.
I prefer steel baths. These plastic things are rubbish.

He has person from local council coming out to look at the bath who will then write to landlord.

In the meantime, you can get some waterproof sellotape. It's quite thick and I used it years ago on an airbed to take it into water.
Failing waterproof sticky tape, superglue it.0 -
It has been taped using heavy duty tape. Lokks wonderful.0

definitely the landlords responsibility - a bath is a fixture - he owns it - he fixes it.0

See this is the problem everyone is of the same opinion Landlord fixes it but at the moment he is saying no. I'm just concerned that if water goes into the flat below my friend is going to get the bill for the repairs.
The Letting company is useless he called them yesterday and asked about emergency numbers and was told they don't give out emergency numbers. So if there is a major problem say over xmas its up to occupant to call out say plumber and pay and then when Letting agency is next open bring bill down and if they decide it was an emergency they will pay up. But they won't put it in writing.0 -
the landlord has buildings insurance. ( or at the very least should)
If the water leaks, your freind CANNOT be liable, as clutton says the pipework and other water fixtures ( baths, shower trays, drainiage etc) are the responsibility of the landlord. No argument, they simply are.
if the water leaks into the downstaris flat, which it will then the owners of downstairs will then put a claim to the LL, the LL and the owner downstairs have to claim on thier buildings insurance.
this is absolutely NOTHING to do with your mate, and she cannot be liable.

go ahead and have as many baths as you want and dont worry - if this plonker of a landlord doesn't realise it will cost him thousands in damage to the downstairs flat - it will be karma which comes round !!! it is NOT your responsibility .....
what an idiot landlord and idiot letting agent - i can never understand landlords who won't repair water damage - its their OWN property they are damaging - how dumb is that ...........0 -
I would have the baths too but friend is worried that he will be landed with either the bill or when his lease runs out that the Landlord won't continue it and he will not get his deposit back.0
