Para 24 mentions Elliot vs Loake. 
This was a criminal case that hinged on forensic evidence that proved the accused was the driver. The scammers have provided no proof the defendant was the driver, and a criminal case case no bearing on a case in the small claims court. The defendant 's statement in their WS is evidence that the court must consider. 

The statement of truth does not conform to the CPR. IT says, The claimant believes whereas it should say, I believe ...
The claimant is a company and therefore incapable of believing anything.

Just a couple of random observations on the Horizon WS. 

The Statement of Truth cannot be made by a company, it must be made by the individual signing it. 

While this is a Horizon case, Gladstones in their ineptitude have headed a couple of pages with the claimant's name being 'UK Car Park Management' which suggests that this was not written by William Dickson and somewhat makes his statement unreliable if it doesn't entirely blow the Statement of Truth somewhat out of the water.
