Hi All,
Its been two weeks since my SAH. I have not heard from the court for the hearing date and I have not been supplied anything from Parking Eye.
I requested that they send me all their documents they intend to use at the hearing and all the particulars related to the case ( phots /exhibits etc) . What should I do ?

Well firstly they have 30 days in which to respond to a SAR and as it's likely the least of their priorities, they won't be rushing to action it.Prettypetty1993 said:Hi All,

ThanksSecondly, a SAR only relates to personal data they hold on you and the VRM of your vehicle. There is no requirement to furnish via a SAR response any other evidence they have about their claim against you, like copies of signage, landowner contract etc. They would come potentially in a court Witness Statement from them. A SAR and a WS are quite separate and shouldn't be confused/conflated.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

When do I submit my Defence? I asked for them to send me details of the SAR. You have said I may have to wait. Understood
Is there anything else I should action and if so in what time frame.

Have you had any written order/directions from the court (not a necessary step for them as the Judge has seemingly already directed you at the set aside hearing)?

Clearly things don't always go according to plan as I got the set aside but I had to pay costs to PE.
Please do ask further questions should you need.
I asked for for 14 days at the SAH , to date I have heard nothing from PE.
What I have received, is the court order from the court, confirming the set aside and costs but it does not mention anything about filing a defence. This is what I need help with.
Do I just go ahead and submit my defence anyway?
Do I do this without having the documents from the other side ( PE) ?

I think I will call the court tomorrow and find out what is happening and how long I will have to wait for a hearing date.Without directions from the court and in lieu of any correspondence this will provide some clarity. Happy to hear anyone’s thoughts/ suggestions1

Can you recall what the Judge said on the day, about what happens next?
Did he/she say that ParkingEye had to send you the claim within xx days and then you would have to submit a defence within xx days?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

He mentioned costs to be paid and that PE should resend the original claim form to the updated address, within 14 days that was it.The judge made a few “in jokes” with the agent for PE ( about he and the agent being very familiar with each other and that the agent follows him around from court to court) I believe he is a circuit judge. As I mentioned he was not very pleasant to me and gave me a hard time at the start. I have a feeling I have not been provided with directions for what I need to action now.1
