Thank you for your email to Liam Brown regarding your parking issue at the Marriott Bexleyheath. Liam has asked that I respond on his behalf.I am sorry that you felt the need to escalate this – and that you feel that it has not been handled well.
We have contacted Parking Eye who have confirmed the following….
A PCN was issued in January 2020 as a permit was issued to your vehicle to be on site for 2 hours, however you remained on site over this time.
Parkingeye wrote to you on 4 occasions between January and March 2020 to the address that was held by the DVLA on/around the 15th January when you were parked on site.
Prior to taking court action Parkingeye complete a final check to ensure they have been corresponding to the correct address. They do so by using a credit reference agency, such as Experian, in regards to your PCN the information was confirmed that you were “living as stated” at the address that the DVLA provided.
In July 2020 the courts awarded a default judgment as the courts did not receive a defence from yourself. At this stage the courts will have written to you to advise of the default judgement and that you had 28 days to pay the outstanding fee of £197.
I understand from Parkingeye that you are in contact with their enforcement team to try and resolve this directly with them.
We have noted your request for a letter stating that verbal approval was given for you to park, but we are unable to confirm the details of any alleged conversation with the hotel team due to the time lapse, I can however confirm that if you had contacted us prior to June 2020, we would have spoken to Parkingeye regarding the PCN and made the necessary arrangements for you.
unfortunately due to the court action taking place we are unable to intervene on your behalf therefore I would urge you to continue to work with Parkingeye through their enforcement team, as due to regulations we are not able to pay the outstanding fee on your behalf. I also believe they may have tabled some options, including a Tomlin order to resolve this directly with you.

As you can see Liam didn’t even bother to reply himself. Marriott are no help at all. Any suggestions , this is disgusting and appalling customer service1

I've just re-read your whole thread again and cannot see anywhere you have denied receiving the original County Court Claim Form?
Have I missed it, or did you receive a County Court Claim Form and choose to ignore it?2 -

I haven't posted all the documents I have sent , I am happy to share but didn't want to litter the thread. Also I read the newbie section first in order to not ask a question that's already answered.
I moved home Aug 2019. The charge was made 17 Jan 2020. The judgment was filed and registered 14 July 2020. At no time did I get anything from PE and only found out by checking my credit file on 12 Feb 21.
I have denied this in my WS, DO and in my original email to Marriott and parking eye ltd. I never received it as they sent it to an old address.0 -

No I didn't get anything from anyone. I have been the one to contact the court and PE and Marriott. I knew nothing until 12 Feb. They have refused to help saying too much time has passed. I didn't even know about getting a charge as they gave permission so I did my due diligence at the time by informing them of the situation and now they are washing their handsCoupon-mad said:Can Marriott not even confirm that you were authorised to be there?1 -
That wasnt what C-M asked; have you asked them to at least confirm you were OK to be on their site? If not DO SO
Have you filed:
- N244 clearly setting out which of CPR13.2, 13.3 or both your set awside falls under?
- A Witness Statament that sets out the facts behind why your grounds (CPR13.2, 13.3 or both) applies to you? Have you made reference to exhibits to support your facts, such as proof of you being on utility bills, council tax, electoral rolls, etc, and then iincluded said exhibits?
- have you filed a "6 point "draft order, in Word form so the court can use it??
- draft defence?
It is more than just a form! That is why we need you to be precise. Because you only get one shot at this, and we need to know exactly, and with no waffle, precisely what you have and havent done1 -
