Team Know How care plan

I have had a TV care plan since 2015 which I pay for every month because they offered to provide a loan TV whilst yours is being fixed. In May last year I contacted them and they told me they don't have any loan TVs available and in the T & Cs is says subject to availability. I said I was to prepare to wait but 9 months on it appears that they don't do any loan TVs and have changed there plan. surely if saying subject to availability, Infers that they do have some when available . I keep getting fobbed off and I was told in January that I was 10th on the list , but this was untrue because I have now been told they haven't provided loan TVs for a long time. Can I ask for my money back from my care plan and ask for replacement TV Because they did not let me know that loan TVs were available and I have continued to pay for this service ?

How much have you paid in premiums over five years for a loan TV that they can't provide? It sounds like a complete rip-off, even if it was only a small sum like £5 a month. You already had consumer rights protection, plus the protection of any warranty offered, so the early part of that five years was completely unnecessary. Sounds to me like mis-selling, but I don't have the legal knowledge to know if it meets that definition.2

Suspect if the insurance policy is unsuitable, that it would be invalid - similar to packaged bank accounts where the perks aren't applicable to the holder.
I'd be demanding all the payments back, but legally not sure what the pressure can be.Peter

Are you saying that they have had your TV for 9 months, or you're waiting for a loaner to be available until you will get it fixed?1

No I have been waiting for a Loan TV before letting them repair mine, I am a pensioner with dementia and cant be without a TV while they take god knows how long to fix mine.0

Do you know anyone who can lend you a TV, or is there somewhere like freecycle where you can get one for nothing, to tide you over why you sort out the matter with Currys?0

You've been waiting 9 months so I can only guess that it is working, working most of the time?
It may be worth you or and advocate giving them a call and stating that you've been messed around, your health
and the fact you do not have another tv.
I hope it is all sorted for you soon.

TBH. If the Op has been waiting 9 months, then there can't be much wrong with the TV.
In true MSE style...
Rather than take out these worthless warranties. Put the same amount aside each months & you will have had enough for a new TV.Life in the slow lane0 -

Well there has now been an update to my problem ( large fly stuck behind middle of screen) They have now informed me because it is a fly , they would not repair because it is classed as a bio Hazard, also they wont replace as stated in the care plan because there is an exception in the T & Cs that if the fault is caused by being exposed to an insect infestation they are not liable. Since when can they get away with classing one fly as being exposed to insect infestation ?
