Personally, I would also complain to Trading Standards about the hire company. They have deprived you of your right of appeal. mand infringed your consumer rights.You never know how far you can go until you go too far.0

Don't forget in your reply to defence that this was never theirs to pay, because the Owner or Keeper is not liable. It was merely a letter from Smart Parking asking for the identity of the hirer/driver but it wasn't a Notice to Keeper compliant with the POFA 2012.
Smart Parking never use that Act (their choice) and can't have held the owner, keeper nor hirer liable. This was only ever for the driver to appeal or pay, and not theirs to take that decision away. Unlike a Police Nip or a Local Authority or TFL postal NTO (and indeed, unlike a POFA parking charge notice) there was no liability on the part of the keeper/owner.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
