why should I ask questions at legal beagles?
Because they are better placed to answer your question. This is a forum about private parking issues, not how to litigate in foreign countries.
Of course the MP is not a hire company,
We all know that but your grammar implied that he/she might be.You never know how far you can go until you go too far.1 -
and you suggested the OP complain to his mp about a not existant hire co , that is actually a car sharing app based in france
dont you think that might be both a wild goose chase for both the OP and the MP0 -
leaving bad reviews on social media may prompt them to talk,as far as the bank goes I would try again hire up the chain .... make sure that you have a T&C's from the app companydo they have a T&C's ?Ralph1

this all boils down to a failure by the concierge who gave you permission
had this of been a conventional car hire co , then the details from the dvla would have shown hire co , that would have informed you
I think there is a failing on the system , as it stands the car owner recieved a ticket from smart , and he was in a position where he should have named the driver , but he did,nt he contacted Getaround who paid it without asking , the company (Getaround uk) should have written to the op and passed ticket on , however they are not a car hire co and are not obliged to in UK law
catch 22 , , all goes back to the concierge who gave you permission to park then failed to fulfil his commitment and warn or explain to the parking co

This is what the OP old us in his first post

Surely we should not be expected to fact check every new post.

Thanks for this guys.
I did raise the issue with the concierge, they said if it was paid, they could have cancelled from their end. Now they can't and I have to appeal to Smart Parking. Building management or the concierge doesn't want to get involved. Also, it's my word against theirs.
Shall I ask for the liability transfer from Getaround so I could appeal it with Smart Parking? Or send Getaround LBA and contest their terms and conditions in court?0 -
getaround are not a car hire co and as such do not have to follow POFa2012 that covered car hire/lease vhicles
you realy need to see there terms and conditions , the website is discusting , there terms should explain counsil / police parking tickets , toll charges etc etc , and a second section regarding INVOICES , invoices from private parking co,s
getaround will be grouping counsil tickets and private together

Get your Credit Card company to do a chargeback.

Castleblackdog2220 mentioned. Interestingly they asking for a letter from concierge confirming the permission to park for free! I think I made a mistake stating I had verbal permission from the concierge.
