  • We understand that, however this is a text forum and you will need to write this down at some point. 
    While courts can make some allowance, they will still expect you to recognise and manage as well as you can.

  • Thanks, it's just I don't want it to seem I'm not trying, I can tell some OPs really haven't bother to read the forum, I have I just struggle to get it all lined up in my head 
  • That's ok - just look back over and work out if it says what you need it to say, and to emphasise that precision is really key here. 
    You need to show they
    - didn't file a claim for ages
    - hadn't had any contact with you, so no reason to think the address they got X months previously was a good address, when they filed that claim

    I'm sure I've seen in other threads suggested wording for a set aside that a lack of response to anything sent to an address* should tell a prospective claimant that the address they are using has some dubiety about whether the defendant can be found there. At the time of raising the claim you had a new permanent address so you were "there to be found".

    * They used the correct address for the PCN and debt chasing letters. At the time of the PCN (NTK) your V5C showed your old address so that is what DVLA will have given them.

    The stuff about DCBL recovery as opposed to DCBLegal letters is something and nothing, forget it.  An ordinary consumer can't tell the difference.

    Hi 
    As it stands I need to complete an updated WS and sent it across to the court and DCBL , my case will be heard in May. DCBL wanted me to pay the fine before they did a Set aside no fee, I said no, I suspect they are up to something though as they said the fact there was no debt assignment was "being sorted"  so court awaits.

    Hi Henrick , sorry i don't understand what you mean or the picture. 

    were they just trying to put me off, and they can't do anything about the fact that i don't owe a debt to their client

    If they had no right to sue they had no right to sue. How are they going to fix that after they sued and "won" ?

    The admission they had no right to sue is grounds enough for a set aside, with costs and, at least a strong rebuke from the court.

    They should be bending over backwards to fix their mess otherwise they'll be bending over to get what's coming.
