    How long do CEL have to provide their own information?

  • A couple of pedantic observations:-

    " Having considered the signage in place at this particular site against the requirements of Section (18) of the BPA Code of Practice............."  -  should be (19)

    (Typo)  -  "In September 2017 an almost identical POPLA appeal versus Euro Car Parks (car park: Kay Street, Bolton) was successful as the Assessor was not satisfied that (adewuate) ......."


    Just a thought  - wrt the old POPLA cases you quote  -  in the BPA CoP at the time the relevant Section was 18 - you have altered them to a CoP in the future  i.e. the one relevant to your case.

    1505grandad: Where the examples quote the assessor I have left what they said, otherwise I have change the CoP paragraph (where I have noticed!). Thanks for pointing out that one I missed and the typo. Also found a random £ sign.

    We have adjourned your appeal

    POPLA understands that during the COVID-19 pandemic, it is going to be difficult or impossible for motorists and operators to effectively appeal. In the interests of fairness, we have decided to adjourn all appeals received 28 November onwards in addition to some appeals received shortly before this time. Adjournment means that appeals will be put on hold and we will take no action until things return to normal. It also means operators are not allowed to chase payment while this appeal is registered with POPLA.

    We have placed your appeal on hold. When we start considering appeals again, we will write to affected parties and let them know what steps we need them to take, if any, to ensure everyone gets a fair opportunity to put their case forward.

    Just received a message that my POPLA appeal is due to be assessed in 21 days, has anyone successfully complained that the BPA member (CEL in this case) have had an extremely long time to look at my appeal and build a case?

    I can't find any code of practice or written terms on their website but surely this provides CEL with an unfair advantage. The time my appeal was in the UK wasn't in a full lockdown and evidence gathering would have been no problem.

    No-one has complained about that because the POPLA letter asks if you want to add anything, so do you?
