Hi 
I recently received a PCN from CEL, I had appealed this decision using the template in the newbies thread but oddly was unsuccessful - looking at other CEL threads they have usually backed down at that early stage so I found it odd. 

I will now go through the POPLA process and search useful examples in this forum, is it best to wait until near the end of the 28 day period or does it make no difference? 
For context the keeper of the vehicle was given a postal PCN for not purchasing a ticket at the ticket machine (which ultimately would have been refunded as they shopped at the store which owns the car park) - unfortunately complaining at the store was unsuccessful.

    Most scammers reject the initial appeal as they don't make any money if they allow them.

    There is no advantage in waiting until the last minute, but PoPLA codes last for 32 days.

    Use all the template appeal points from the third post of the NEWBIES, then post the draft here for checking before you submit it.

    What happened when you complained to the landowner?

    Where did the alleged event occur?

    Thank you for the quick reply. Noted, I will gather evidence from the car park and put together a PoPLA then post it here! 
    Landowner (or whoever the senior staff was at the time of asking) said that they don't deal with it and I need to complain directly to the "car park manager" and that unfortunately they couldn't help. I will try again next time I go to the store though as maybe the next person will be more helpful...

    Sorry if its a silly question but can I say exactly where it happened? e.g. the name of the car park and town? Don't want to give anything away if they scan through these forums!

    As long as you don't identify the driver there is no problem telling us where this happened. Someone may know the site or it may have have cropped up on thios site before.

    If it is a stand alone store, then start with the store manager and/or CEO.

    If the store is in a retail park, do the above but also find the landowner and complain to them.

    Include copies of receipts/loyalty cards etcetera.

    You can tell us the location and if it's a retail park , there is ALWAYS a landowner , but finding them can mean doing some digging to root them out

    Shops tend to rent from managing agents acting on behalf of landowners

    Yes these companies do read these forums , I would if I owned one !! They also take screenshots

    Thank you, I will complaining again this weekend - it is madness as the driver would have been refunded the cost of the ticket after shopping at the store! Location of the private car park is 99 High Street, Waltham Cross, Hertfordshire (the store is Turkish Food Centre).

    Did you actually purchase or attempt to purchase a ticket?  Was the PDT faulty or was there some other reason why the PPC are claiming you did not purchase a ticket?  Maybe it wasn't displayed, maybe it flipped, maybe you didn't input your VRM?

    Is this the place?

    Fortunately, the camera car entered the site.

    The car park is tiny, about a dozen spaces in amongst the goods entrance for two or three shops with delivery vehicles and fork-lift trucks operating. The entrance signs are on the wall and the open gate, both at right angles to direction of travel, at the far end of the single track entrance road.

    The pay machine is over the driver's right shoulder on the back wall as a car enters, and would not be visible, even on foot, if there was another vehicle parked in front of it.

    Tariffs can be read on the GCV images, but the rest of the text is in small font. If there is a charge, it is buried in that small print, so it would need a site visit to determine what it actually says.

    Is the NtK PoFA compliant?  Many of the CEL ones have not been, but lately they seem to have plugged the gap in some NtKs. Check on the reverse of the NtK in the grey shaded area telling you about payment procedures. It begins something like 'If after 28 days ..... '  

    Also please give us:

    Date of the parking event
    Date of Issue shown on the NtK.
