    I did post but I think it was on another chain. 
    The machine was often broken, I'd often knock their window to tell them it's broken. I have a pile of handwritten parking tickets to prove the lack of maintenance. BUT when I got a PCN I'd paid, the ticket was clearly on display, and so I'm not the same as some of the other claimants. I'm checking with DCBL they know their client has dropped the case, as the email alone doesn't give me too much comfort. 
    the case is not dropped untill you get conformation FROM THE COURT , not wilber or dcbl THE COURT

  • Yes @Snakes_Belly - I'm checking frantically. 
    I did get handwritten parking tickets on headed paper. I parked by the crown in digbeth, where the office is adjacent. I'd parked their daily for a whole year. Then I come back one day, having paid and displayed, and had a PCN. I was gobsmacked.

    Thanks. It's a strange set up. Like BD says get confirmation from the court.

    Whilst this isn't your thread, there is no point in starting one since the PPC seems to have cancelled.  However, if you received an N1 claim form, you should tell us the date of issue of the form because (although the PPC say the case is cancelled, have they told the court via the N279 form)?  Until you hear from CCBC you should continue with the AoS and pull together a defence just in case.  If you fail to meet any deadlines, the PPC could come after you with a default CCJ for failing to acknowledge service or failing to file a defence.
    Here, did you mean you submitted a SAR to the DPO of the PPC?

    You do still have to defend but you DO NOT fill in the N1.   Nowhere on this forum do we tell people to start filling in the claim paperwork!

    You must assume you have to crack on with the forum's TEMPLATE DEFENCE until you know it's discontinued.

  • katyanne7 Just as a matter of interest did you have to obtain a hand written ticket every time you parked because the ticket machine was not working? If so how long was that for? Thanks.

    That is interesting because there are two cases regarding disappearing pound coins in different car parks in central Birmingham.

    If the man in the hut was not there and someone tried to use the machine they would get a ticket. He cannot be there 24/7 or does he live in the hut?

    yes there seems to be a lack of accounting going on , payment by card payment by cash at machine , hand money to a man in a hut *** (see below)


    a common senario , I seem to recall a case possably in scotland where staff member had pocked several thou 
    in wilburs case , his intention has never been to be a car park operator , a job he moved to when clamping was banned 
    he leases bits of derilict land , and pays buisness rates , after paying for meter install , or staff there is no profit , his profit is purly by issuing tickets 

    givuing up clamping and joining a ATA does not make you legit , it just gives you a shield to hide behind 
    and to make you smile
