    Hi, is it not the case that I will see the claimant's witness statement? I now only have until 31st August to submit mine, which I have not overly extended other than more on the 'double recovery'.

    You will get to see the claimant's WS. Hopefully it will arrive before you need to send yours so if you show it to us as soon as you get it, you will be able to include our comments in your WS.

    You both have the same deadline , as mentioned in your court order , so they have just over 2 weeks , same as you

    The claimant has the same deadline as you to file and serve their WS. You may be lucky to see it ahead of the deadline so you can possibly tweak yours accordingly, but the real likelihood is that they will file on the final day. Just plough on with yours.

    I cannot find anything on this; how does my witness statement need to be filed with the court and claimant? Does this need to be in hard copy (so via post) or can it be digital in both instances?

    Thanks, I e-mailed my WS direct to the court (I checked directly with them about this). Also thank you for the additional information, I put those items in my WS too.

    When and how am I to receive the Claimants WS, I have received no correspondence and the deadline was 31/08/21 at 2pm. Or will I just see it on the trial date?

    The Claimant had the same deadline as you for filing their Witness Statement and evidence with the Court and serving it on the Defendant.

    The deadline when you emailed it to the court was their deadline too

    Plus I hope you emailed a copy to the claimant or their lawyers , because you had 2 destinations , same as the claimant

    So the court and defendant should have received theirs too

    The court order gave both of you the same deadline , neither of you is allowed to ambush the other on the hearing date
