I suspect that it's because recently their legal reps are making a pig's ear of it so are bringing it back under their own control , no it's not normal but no Biggie and if that pattern continues its qué Sera , Sera !!

You should concentrate on your own case and not be interested in what the claimant is doing , if they are saving money and bringing it back in house then nothing that you can do about it !!

Your job is to fight whoever they allocate on the day , regardless

    Hi All,

I received a 'Notice of Change of Legal Representative' via post the other day stating that their legal representative has ceased to act on their behalf and that they will now be acting in person.

Is this some sort of tactic; is it normal? They have offered to settle a reduced amount in their covering letter, which I intend to ignore.
I would not think that it is a tactic. Not in this instance anyway. I would say that it is down to costs.

Very interesting to see cases where VCS are dropping Elms Legal, given their documented connection with Mr Shoreman-Lawson:

    Hi All,

I have been trying to write my witness statement and I was wondering if anyone could take a look and critique and give me any pointers. This is all new to me, although I have tried to base it on ones on this website that have been highly  recommended .

The redacted file can be downloaded here.

I look forward to hearing from you - thanks!

It seems a little short to me. The current advice is to base yours on the one by @jrhys

If I am correct, it's this one.

If/when you have the claimant's witness statement, please post it here as soon as you get it. Only redact YOUR personal data. I cannot stress how important it is for you to note the words I have highlighted.
Upload it to Dropbox as you have done yours.

We don't use the term "Abuse of Process" anymore, it is called double recovery.

it has a meaning...but was being misunderstood and battered to death by newbies who didn’t understand what they were saying and that ‘abuse of process’ isn’t a defence point.  So it had to stop!

As you say OP, the abuse of process came from Southampton and was quickly picked up by this forum.

In reality it is still abuse of process and most certainly is "double recovery"

Cases were being struck out all over the country mostly those by BWLegal

There were appeals by BWL and this resulted in judges not dismissing cases for just abuse of process.
BUT, the judges know it is abuse of process

Even at this stage you can still write to VCS and ask on what legal authority do they have to add £60.  There is no answer and they will ignore you.
In court you will use a crib sheet and when it's your turn to speak, you will tell the judge they cannot explain to you the £60 and have ignored you ?

The claim signed as a statement of truth to which part of they cannot explain

So, VCS will have to prove to a judge that there is a charge for debt collection when we already know that the debt collectors offer a "no win no fee service"

They might try and say that code of practice allows them to add debt collection charges ?
This of course would be total rubbish as the code of practice is not for the motorist or a court judge and carries no legal basis as the code of practice is unregulated.
Even if they say there is clause about this on the signs, it is only in small type and not fit for a motorist to read.

I am saying all this because you need to help the judge so he can dimiss the claim as a fake

Many thanks @Timeouts , I am going to write to their litigation department asking the following and see what they come back with:

"I write to you in regard of the above-mentioned Parking Charge Notice. I would like to seek clarification as to what legal authority Vehicle Control Services Ltd have in adding £60 to the original outstanding balance, as informed to me on your Demand For Payment, dated xx.06.2020"

Let me know if you think there would be anyting else worth mentioning.

    Thank you.

Don't expect an answer - they won't have one - except to point to the Code of Practice which was written for them and is not binding on the motorist.
