    OPS can't (shouldn't) get keeper data until after day 29 from the date of the alleged event (PoFA para 8 applies). They then have to fire an NTK to Arval who then have to provide OPS with the hirer/lessee's details. OPS then have to send a NTH to the hirer/lessee/ day-to-day keeper.

    The important thing is to ensure Arval do their job properly and name you to OPS as the hirer/lessee.

    Have you complained to your MP and your councillor, and asked them to forward the complain to the MP and councillor for Stanmer Park if different to yours?

    Just be aware that the BPA seem to have a limitless supply of whitewash.

    It's ARVAL's keeper data they will get, this month, about 30 days after the PCN date.  

    You MUST ask ARVAL whether they have now received the NTK (non-POFA, so remind them again that they have zero liability in law) and remind them that they must provide your name and address as hirer, so that you then get a NTH yourself and can take this over, appeal and win.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    All the landowner contracts between Brighton and Hove City Council (BHCC) and OPS, between 2013 and 2021, are available in this FOI request:

    Hopefully somebody will be contacting BHCC to ascertain when the contract for the period 1st December 2015 to 30th November 2017 was actually signed because Ethical Parking Management Ltd changed its name to OPS on 7th May 2015.

    According to Companies House, OPS/Ethical Parking Management was dormant until 30th November 2015.
  • there is a variation to the contract signed 
  • all I have is a variation of Ethical to OPS as part of externsion for one year dated 2017. A lot of the estate roads are bridleways so not private land. Highways Act has notes that 50yds either side can be crossed for parking.
    Maybe something in that. See BHCC definitive map to identify where bridleway is. There is public toilet, church, bus stop so there is strong case for using the Highways Act to claim all roads are Byways Open to All Traffic.
