Do these sorts of 'class actions' (I know they're not called that in the UK) set legal precedents such that if successful and compensation IS awarded, then anyone owning one of the affected vehicles could apply on an individual basis because the 'case' has already been proven.
Didn't this happen with the PPI scandal? Once the case was established anyone could apply individually without got to one of the numerous 'ambulance chasers' that cropped up.
So, perhaps the best strategy with this emissions thing is to wait for a legal judgement in UK/Europe to prove the case and let others take the risk of an expensive court case losing and incurring a share of the costs?
There was a court challenge that the then FSA won in 2011 that said that the rules could be applied retrospectively (an utter joke!)0
