The PCN letter was addressed to my husband as he’s the registered keeper0

as above, read the advice first , like a lot of newbies you are trying to rush it without learning the basics firsta landowner cancellation is you best option, was , is , always will beyour popla appeal will be based onno landowner authoritypoor and indequate signagegrace periods in the BPA CoPit would have had POFA at the top of the list if they didnt or dont cancel it, but you threw that winning point in the binthe driver was liable, the keeper was not liable , you dobbed the driver in, so lost that winning pointif he was the RK, then you have dobbed in yourself as driver (or him as driver depending who appealed it) , you said you received the letter, no you did not, he didin future, let the person named on letters deal with those letters1

I never said anything of the kindwe have no problem with you appealing on behalf of your husband , just tell us the factsdid you appeal on his behalf in his name ?or did you appeal as the driver in your name ?clarity is everything here , and you havent really told us properly1
-
I completed the appeal form in his name as the registered keeper. Please don’t get annoyed with me, I’m having to deal with so much being on my own0
-
ok , then the problem with that is you have confirmed he was the driver, which he was not, because you said you wereany rejection will be in his name , not yours , and they will take it that he was driving due to what you have said so fartherefore the popla appeal will have to be in his name too, using the elements I listed earlierthis shows the problem of you doing things in his name, had it been a court case you would be really in trouble , so learn from this and be careful what you admit to in either name. sometimes NO COMMENT is bestps:- there is no guarantee of any win on this , especially not with the current POPLA2
-
Ok, I understand. So now I just have wait to hear back from the appeal then take it from there. If I need more help do I tag to this post or create a new one?1
-
good , now stick to this thread, dont start a new one unless its about a different pcn at some point in timeread other popla appeals over the last 18 months where the driver was revealed and look for what I mentioned about landowner authority, poor signage and grace periods , construct one to be submitted in his name choosing other on the POPLA website and as a pdf upload , so you are ready if or when they reject HIS appeal as driveryou will now notice that one of our biggest tasks on here is stopping people blowing their toes off, something your hubby or partner is fully aware of0

So darn frustrating. Such a flipping easy one for a keeper to win.
We are not angry with you but come here FIRST!
HIS 100% WIN IS IN THE BIN AND HIS CHANCES ARE NOW NO BETTER THAN ANY OTHER CASE.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
