Letter of Claim received from DCB Legal

Reply to MOTO and tell them this was a formal complaint not an appeal and that DCBLegal do not offer any 'appeal'. Court is being threatened and you want to find out if MOTO care enough about drivers being allowed to sleep when on a long journey, as your son was (explain if you know some details) to step in and cancel this with their out of control, litigious bully parking contractors before you contact the national press, because this can't happen to people in a civilised society at the best of times, let alone during a pandemic just because CP Plus are unable to 'fine' people and aren't making any money (express your distress again...).
You most important emails are to MOTO right now - keep pressing. AGAIN AND AGAIN.
Don't come back to ask us to comment on any new email, just do it yourself and get angry about all this. Keep replying and making it clear that all you are asking is that MOTO exercise their customer service ethics as landowner and stop their contractor from causing this abject misery to you and your family.PRIVATE 'PCN'? Also, When I email DCB Legal and ask them to put on hold for 30days as I am seeking legal advise. Does that 30days start after the first LOC 30days or from when I write. In which case would it not be prudent to wait a couple of weeks to ask for the extension.0 -
I would suggest push MOTO first.
It starts from when you write, however DCB may file instantly the 30 days are up, or even before - as courts dont seem to care about a breach of the PAP - so I wouldnt cut it too fine.2 -

When you write that letter, you are requesting a 30 day hold because to are seeking debt advice, not legal advice.
Perhaps a sentence something like:
"Although I deny any debt is owed, I am seeking debt advice and as detailed in paragraph 4.2 of the Pre-Action Protocol for Debt Claims I require you to delay further activity on this Claim for thirty days".

I have written several emails to Moto including one to Mr Leatham. One as an appeal then others as a formal complaint but all they do is forward them to CP Plus as "they are appointed by Moto to manage parking and appeals". In the last one I said "Just because CP Plus are unable to 'fine' people and aren't making any money, they are putting money over safety". As this has been sent to CP I am sure they will not take too kindly to this and won't help my appeal.
I am sending today the following to DCP "Although I deny any debt is owed, I am seeking debt advice and as detailed in paragraph 4.2 of the Pre-Action Protocol for Debt Claims I require you to delay further activity on this Claim for thirty days. The landowner has also requested the matter be placed on hold while the appeal is being considered" The LOC was dated 13/01/21

As this has been sent to CP I am sure they will not take too kindly to this and won't help my appeal.Who cares whether CPP 'take too kindly', nothing is going to make any difference. A Judge will do that, if it gets that far.
