Letter of Claim received from DCB Legal

Hi. My Son received a parking ticket at MOTO Tamworth on 24/06/2015. He stopped as too tired to drive. Fell asleep and overstayed the time. He ignored all letters to pay as was the information at the time, these letters then stopped arriving. He then received a letter late last year, ignored and now has received a 'Letter of Claim' from DCBL. He went travelling abroad early 2017 and at present is traveling in South America with no fixed address.  We open what little mail he gets. He has not lived at this address since 2015. His car is on a Sorn and still registered at our address. The 6 years is up in 5 months.
Do we continue to ignore? Will court action be taken without him present? We do not want him to get a CCJ without him knowing. Grateful of any advise as worried sick.

As it's MOTO, who do DCBL say who they are claiming for ?

It will likely be a CP Plus case. You can try to complain to MOTO on behalf of your son, they have helped one or two others from this batch of barrel-scraping resurrected old PCNs.

But it really should be your son doing this, although I do recognise what you've said about his whereabouts. When do you think he will return to the UK?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

My Son has no plans of returning anytime soon. The fact that he personally has not received the letters and does not live at the address they were sent to can they still take him to court in his absence? What happens if we continue to ignore?

MOTO Head office have been cancelling these this month.  The more complaints, the better and if you don't your son will be sued (but we still win in court!).  I am sure MOTO will cancel if you email them and explain the distress caused to the family.

can they still take him to court in his absence?
    Yes.

Your son will get a CCJ and his credit will be ruined for six years.  And you might get bailiffs at the house in the end.

TO BE CLEAR, WE ARE NOT NOT NOT NOT NOT TELLING YOU TO PHONE THEM, NOR TO PAY!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I would inform DCBL that your son is travelling in South America with no idea when he will return home. You do not have a service address for him .
Tell them to cease writing to your property or even think about a court claim as it CANNOT BE RESPONDED to

PS: DCBL ARE SCAMMING YOUR SON WITH A FAKE £70 ADD-ON

OMG, in tears as we speak, feeling sick
What sort of thing should we say to MOTO to give a good case to cancel ? and 'Beamerguy' suggests we also email DCBL , are there any legal quotes we can send them. Thank you so much for your help, if I had the money I would just pay it for him.

I would say exactly that, explain the distress that is being caused.  Just read all of this thread and a few similar ones about MOTO/CP Plus and you will see what other posters are doing.

I read the similar ones as you suggested and they all had stayed at the motorway hotel, therefore free parking. My Son fell asleep in his car for a few hours as too tired to drive.
If I decide to pay now would it be the £170 or would they add the 8% interest on making it £183.60 ?

It is not £170, they have added a fake fee for debt control or admin costs.  You (well your son) could still contact MOTO and give them a hard time especially when the Government (via the Highways agency) order (OK technically it is advise) motorists not to drive tired.  Nothing ventured, nothing gained but, unless you are the RK, it has to be done in his name.  If he is overseas for the foreseeable future why not write to the PPC and give them an overseas address for service.
