Uc question

Hi my son has moved in with another family the mother is currently claiming on her uc for him but apparently only getting £16 a week. Can he put a claim in for uc on his own while living with them and still at school.

Any advice

    No, because students can't claim UC. Who's only getting £16 a week?

    The family he's living with said that's all they get for him.

    On UC the child responsibility element is £281.25 (if there are no other children) or £235.83 if there are (monthly amounts). However there is a two child limit unless all children ere born before April 2017. Do they have other children on their claim?

    What about Child Benefit?

    If they have accepted responsibility for him then sorting out any benefit support for him is their problem, not yours. Key point is that he cannot claim himself if he is below 16. Once he reaches 16 he may be able to claim himself. See https://www.gov.uk/universal-credit/eligibility
    If you’re 16 or 17
    You can make a new Universal Credit claim if any of the following apply:
    • .....
    • you do not have parental support, for example you’re estranged from your parents and you’re not under local authority care
    If you’re studying full-time
    You can also make a claim if you’re in full-time further education and any of the following apply:
    • you do not have parental support
      ....

    Obviously he cannot claim benefits himself under this if somebody is claiming benefits for him because they have assumed parental responsibility.

    She has 3 other children on the claim according to him she gets 1339 a month but is paying back debts. So would that be about right.

    As per my previous post whether she will get a child element for him depends on the ages of the children. However regardless of this there is no way of knowing what her UC entitlement will be without knowing all her circumstances.

    We can answer you question about whether or not your son may be eligible to claim. As with the previous thread we cannot answer questions about what the other daily may or may not be entitled to.

    He is claiming no parental support but if they take it as her claiming benefits is support then suppose he can't.

    If he's only 15 then he won't be able to claim UC.  I don't even know how your son knows exactly what this person is claiming or receiving, as it's really not any of his business.

    He's 16 now and he says that she gives him her card to go to the shop some times.

    So, if he is without parental support, he could claim UC. How he will evidence this to UC I don't know and since none of us know whether the other family are claiming that they are supporting him we don't know whether he is without parental support or not.

    Honestly don't know i was told that the school was helping her with her claim. Then got told she didn't need to claim for him she could afford to have him there without extra money. Then it went to £16 a week.
