I've found out a lot from researching this forum and think I know what my next steps are regarding Letter of Claim response. Can I ask if anyone knows how soon after the 30 days to reply and the 'at least 30 days negotiation period' before court proceedings are issued?
The letter also asks for payment of £170 plus further costs and 8% interest per annum if a claim is issued. Can this be enforced?0 -
Can this be enforced?Interest, possibly, court fees, yes if you lose (£25 filing fee and £25 hearing fee).
But what does the template defence tell you about the added £70? I am astonished anyone is asking. The forum covers this scam fake cost entirely.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The facts are that this is a debt collector who has mutated to a rogue trader
This wacky way of running a business has come about because parking companies are going to go bust ?
Your complaint to the SRA is vital and I would be contacting the Lord Chancellor and Secretary of State for Justice, Robert Buckland MP.
I would also ask the national press to investigate BWLegal and to warn a very gullible public.
We don't know how many of these letters they have sent out and for those who paid out of fear, there is a case of a refund as this stinks of another Wonga.

Currently BWL are stupid enough to think that the code of practice allows them to add on fake amounts.
Here is the clue ...... 7 years ago there was no mention of any such thing in the code of practice

@Mr_Bolshy are you referring to a statute barred debt or one approaching six years? I think that you need to clarify your position on your own thread.
If the parking incident was six years ago it is a statute barred debt and the claimant will not be able to enforce the debt. The debt does still exist and they can ask you for repayment.
It sounds as if their claim is approaching six years.

There is nothing stoppnig them issuing a claim immediately. The PAP for debt claims has naff all teeth as courts dont seem to care about breaches of it.

If you start negotiating you are admitting the debt which will effect the limitation.

Yes their claim is approaching 6 years. I understand not to admit anything. My first time on any forum so apologies if I’m doing stuff wrong! So as I understand it I’ve got 60 days before they can take me to court? It’s a matter of just a few days on top of the 60 that gets me to 6 years!The second question was if they do take me to court can it be thrown out because of the extra charges they’ve slapped on?0
