Can I cancel?

Hi. I ordered a Ping driver from American Golf. I have been waiting 10 weeks for delivery to the store and, with the current restrictions, I haven't a clue when I'll actually get it. By the time I get it their new driver will be in the store for a similar price so I tried to cancel today. They told me I couldn't as it was "custom built". This isn't strictly true as all they do is attach a choice of shafts onto the head. Nothing was cut specifically to suit me. Does anyone know my rights? I don't need a refund. Just want to upgrade to the new one. Thanks

"Custom built" doesn't apply just because you picked options from their catalogue, you're still entitled to cancel (assuming it's a distance purchase).0

Made to order has the same cancellation rights as off the shelf, its only when you get into the realms of bespoke that you forfeit rights to cancel due to a change of mind. It can be a little difficult to tell the difference between the two at times but most helpful retailers will clarify up front which is which.
I am not sure under DSR how "click and collect" are treated, which seems to be what you have requested, but assume full rights apply as the principle is that you are bound to the transaction before seeing. Obviously if you did the order from in store thats a whole different ball park.0 -
They call it custom built but its a chosen from a range of shafts and paired it with the driver head. They can both go back on the shelf. My argument is if it was, for example, a made to measure suit I would feel obliged to buy but this is more like an off the peg jacket being paired with the correct sized off the peg trousers. ie closest fit. Nothings been cut to suit me so they could both be re-sold.0

Hi - As you ordered in store then you have no automatic right to cancel based on change of mind, unless their T&Cs allow you to. Whether the extended delivery time gives you a cancellation option I don't know - what terms were agreed with the store at purchase?
Also, what have you actually paid till now? The full price? A deposit? Nothing?

As long as you (or the fitting pro) is selecting solely from an existing range of shafts and heads and lie angles etc, then it shouldn't be treated as being bespoke (not custom made). Where I would be a little unsure is if the fitting pro (or Ping themselves) have to tweak anything like the lie angle to fit your swing. I simply don't know how far that personal adjustment can be said to be within a selection range as opposed to being bespoke. I suspect it still isn't bespoke, but I'm not sure.I generally find AG to be OK, but after a ten week delay and if a new model driver is available, I'd want the new model - or a significant reduction in price.0
