Car problems - Hire Purchae

Hi
I purchased a car on hire purchase 2 weeks ago. It’s an electric Nissan: the range should be about 159miles fully charged. The day after I purchased I noticed that the Barry was only showing 11 bars of health, the warranty would be void if I did not get a full Nissan service within 2 weeks and there was only 89 miles on the battery fully charged.

I then got it checked by Nissan and they told me I had a faulty cell on the battery which had reduced the range.
The car also broke down on me and I had to call rac. This was when I had 30 miles range and it went to 0 in 1 mile and conked out. I was left stranded for 4 hours waiting for a pickup.
So I emailed the dealer to reject the car based on not fit for purpose, fault battery does not have the range required to fulfil its use.
The dealer said no. So I then contacted the finance company I pay for hp with. They sent a car inspection service out: they did certain tests and said while they can’t do a full battery test they can see there is greatly reduced range and cell 82 is faulty.
they gave the report to the dealer and said we are returning the car. The dealer said no he wants 14 days to do his own inspection. The car finance company said I have to do it:
it’s being picked up tomorrow from my house.
I don’t have time for all of this. I got this 11k car to Commute to work in January. I just want it returned and to find another car ASAP.
Do I have to now give him 14 days? Can I just reject now? It will not be in my possession from tomorrow.
thanks

You are being deliberately mis-informed by the Finance Co.The car a serious fault at the time of delivery and it is your right to reject the car within 30 days of purchase, only if it is beyond 30 days does the dealer have the right to fix the problem, and he has only one chance to do that.Return the car to the dealer with all it's paperwork and keys, with a letter of rejection0

I read is at the finance company say the OP has to reject it. It’s the dealer who is saying nodogshome said:You are being deliberately mis-informed by the Finance Co.The car a serious fault at the time of delivery and it is your right to reject the car within 30 days of purchase, only if it is beyond 30 days does the dealer have the right to fix the problem, and he has only one chance to do that.Return the car to the dealer with all it's paperwork and keys, with a letter of rejection1 -
Why didn't these things show up when you test drove it and inspected it? Also, poor Barry only showing 11 bars. Sounds like the spark has gone from himcrunk said:Hi

The Finance Co agree that the the car is faulty and should be rejected - It's the 14 day inspection period demanded by the dealer that they say the OP must accept,.which is rubbish..With both Nissan & the Finance Co.saying the car is faulty, the dealer has absolutely no rights to insist on anythingREJECT REJECT REJECT0

Yep good old barry. I could find no way to edit my post once written...
I just need to know my rights. First response finance say that I just give him 14 days now: it’s so long winded. I need a car for 15th jan.
The car has now gone. It’s been taken to the dealership by a truck which finance company sent.A solicitor said to me because they actually own my car (the finance company) it’s up to them if they grant him 14 days...0 -
I have just emailed the finance company saying the car has been collected and I won't be accepting it back. They seem to think although I have been patient and allowed them to send out an inspector who confirmed the fault and now want me to wait another 14 days for him to do the same.0

They do have the right to inspect the car. Your right to reject a faulty car is not in dispute, but they also have a right to have their own inspectors confirm the fault and not just buyers remorse.1

With the car now sitting at the supplying dealers premises without any rejection letter, the OP is now stuck with the dealers 14 day inspection periodThis has been forced upon him by the Finance Co, no doubt in the hope that the dealer will fix it and they won't have to unwind the finance deal. But this is not a PCP deal where the Finance Co do own the car - It's an HP deal where although the Finance Co. have a lien on the car until it's fully paid for, they don't own the car and have no right to enforce the OP to give up his consumer rights0
