UK CPM PCN question from a Newbie

Options
Hello there.
I have to admit I am petrified of posting on here. I know there is a whole lot of very useful info and I love the link of what to do to start with but I really would like to ask for some non judgmental advice. As in yes I have been staring at pages of info for the best part of three hours but still need to check if I understand this right.
Don't pay - yes I like this as a starting point :-)
Don't contact them - first of all go to the retailer - I can do that.
Don't admit who was driving - does that only apply in certain situations ?

I have a PCN from CPM for GBP60.00 as I was parked over the lines ( ever so slightly ) the photo of the car from 2 angles was provided in an Aldi car park.
To my right there is a car in their space and to the left there is a car in a space. I have not taken up a space in Aldi car park for someone else but yes I cannot argue my left hand wheels are just over the line. Just.
So if I have read it all right I should go to Aldi and complain directly to them that I feel I am being bullied by their car park owners and see if there is anything they can do.
We have been to the car park and looked at their sign and it does say must park within a marked bay.
So if Aldi say so sorry nothing we can do from here, as I have received a PCN then the next thing to do is appeal. It seems easier to appeal over time rather than being slightly out of my space. I cannot see that anyone lost out due to my parking financially so what I am really asking is on what grounds am I appealing?
I know the answer is in this myriad of fantastic advice but I cannot see it. Even templates aren't specific to my case.
Please let me know if I have a case and which angle after seeing Aldi I should go down. Thank you.

Many judges will regard your "offence" as a trifling matter, read this and complain to your  MP. and the landowner.

No blabbing about who was driving

CPM are not the car park owners , they are sub contractors

Complain to Aldi as a customer , preferably with proof of purchase , complaining as a keeper and a customer

If they aren't the landowner , complain to them or their managing agent

Any complaint to the PPC is the blue text template , as keeper , no blabbing about who was driving

This will be rejected , so expect the rejection , don't get your hopes up

The grounds of the appeal are in that blue text template , nothing to do with what happened on the day

You have revealed the driver's identity in your opening post, so be just as careful what you put here as what you send the the ALDI CEO (or landowner if different) and the parking scammers.

If ALDI won't cancel, then do not miss the keeper appeal deadline, and shop elsewhere in future.

Aldi don't contract with UKCPM so it will be whoever the retail park landowner/managing agent is, who can get them to cancel this.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's still worth complaining to ALDI as well because retailers on some sites have the ability cancel a charge.

The Template you are speaking of is the one that starts...
    Re PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

So in my case they sent two pics of my vehicle but no picture of the sign. So as per the template I am just asking for a picture of the sign. Is this a stalling technique that will be declined ? Or does this sometimes get listened to and written off ?
There was no machine involved and no over stay just an accusation of being outside the space.
So just copy and paste the above and email via their appeals process online ( need to find if they have one) ?
Also I am unclear as one reply says yes complain to store and one says go to the land owner. In this case if coupon mad says go to land owner and after a quick google I find
COIF Charities Property Fund as the owners - does this sound right?
I can see why people just pay these things to make it all stop.
If you think I am going about this all wrong please let me know.
I feel like I am out of my depth.

You won't get a picture of any sign until the exhibits (evidence) stage , it's not your personal data

Yes it sounds right , sometimes a retailer can intervene but it's the true landowner that has the real power , always , so exhaust every avenue

Most people are out of their depth that come here for swimming lessons, so you won't see many orca or Olympic swimmers here , just flounderers

You complain to the store and if they fix it for you, great.  If they say "nothing to do with me guv" you go to the landowner on the basis that the landowner contracted with the parking company and is responsible for their actions.  Appeal to the parking company within the deadlines set by them IF the landowner complaint does not work.

The appeal you are proposing to send as the keeper of the vehicle includes:
There will be no admissions as to who was driving and no assumptions can be drawn.

Your opening post tells the world the relationship between the Registered Keeper and the driver.

The parking companies are known to trawl this forum just waiting for people to trip themselves up and can try an use the information found against you.

They already know it's an Aldi car park, just a few more little slips and your parking event will be uniquely identifiable

  • Wow so from me saying I received a ticket from an Aldi car park is enough for them to deduce. Thanks for the tip and I thought I was being careful !
