BW Legal / Link Parking Court Summons on Resident Parking Permit Land (I have a Permit!)

  • Oh dear, this never ends! So I got a letter from BW Legal stating that I had to pay them £340 (the reduced amount) by 15th July. That’s fine and what I expected…and as yet I haven’t paid it but I will of course…

    However today I get the official court letter which states pay by 29th June, and the full amount if £458.02 which is NOT what the judge said on the day, and is backed up by the amount BW have requested!

    What do I do now?

    You reply to the Order by email immediately and attach a scan or close up photo of the BW Legal letter and point out there is an error in the Order. Explain what the judge said on the day and point out that BW Legal also clearly agree, so you ask that the error be put right under the ‘slip rule’. 

    Copy in BW Legal and ask them to reply to confirm from their notes that this is indeed the case and that the figure of £340 and settlement date of 15th July as shown on their letter reflects the intention of the Judge.

    I’d head the email up:

    URGENT - error in order re claim xxxxxxxx heard on (date) by (Judge’s name).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Ok, that’s great, thank you. 

    I’ve just been sorting out the paperwork and I have noticed some things which seem off.

    The Claim Form has a breakdown of

    Amount Claimed £318.02
    Court Fee £35
    Legal Representative Costs £50

    Total £403.02

    The letter from the court has “the sum of £318.02 for debt and interest to date of judgement and £140.00 for costs amounting to £458.02”

    Surely costs are what’s being claimed (£85 for fee and legal) why can they add another £55 on?

    What was said in court was that they couldn’t claim recovery or interest and the judge asked BW legal what the total was, they said £340 which I assume is £200 for the two tickets plus £140 costs.

    Should that not be £285?

    Just want to make sure before I send the email I get it all correct.

    No idea but you have the letter from BW Legal so just do what I said, you have to be quick to get something sorted under the slip rule.

    Ahhh, thanks for that, it explains the difference. That's pretty sneaky to be honest as the actual amount taking off the double recovery and interest which the judge told them they couldn't claim brought it down to £285 with £200 being the actual "fine". It was the double recovery and interest that pushed it to £318.02 before costs. :/

    Yes, sent them an email this morning with a scan of the letter sent to me by BW Legal, and copied BW Legal litigation into it to ask them to confirm the intention of the judge.

    Not had anything back from either yet.
