Ninth Anniversary 10 Posts Name Dropper Combo Breaker
Hi this is my first time posting as i need some guidance. I have been reading many of threads and have been convinced and gained the courage to attempt to defend myself in court. I have followed all the guidance in the newbie thread and have now submitted my defence. I'm not sure if this was a mistake but I think i have possibly made the mistake of submitting the AoS without correcting my name to my full name. The claim was made in my middle and last name but when responding with the AoS (submitted 27/10/2020) I did not correct this in the top left where i was supposed to and entered my full name in the address section with my full name and address, and submitted my defence (submitted 10/11/2020) with my full name also. I have now received a letter from Gladstone (on 18/12/2020 dated 10/12/2020) stating they received my defence form and have noted there is a name difference on defence form to the one they hold on there system and now require me to send them proof of my name so that they can review whether they need to update their system in relation to my name (not really sure what all this means). It has been over 28 days since I submitted my defence. I have not received the Direction Questionnaire and this is the first I've heard from Gladstones since I submitted my Defence. So my question is what are my next steps? Do I send my proof of name or wait for the Direction Questionnaire to arrive. Thank you in advance for any help.

    You say the claim was raised against you using incorrect name details? Has all previous correspondence (from the PPC, debt crawlers etc.) always had the incorrect details?

    Para 3 is essentially asking if you need to send them a Data Rectification Notice to ensure that their records have the correct details with respect to yourself.

    Para 3 is essentially asking if you need to send them a Data Rectification Notice to ensure that their records have the correct details with respect to yourself.
    All correspondence have been in my middle and last name, I commonly use my middle and surname only and my vehicle is registered in my middle and surname with the DVLA. Therefore they have been using the names given to them by the DVLA. 

    I received acknowledgement of my defence being received by the court and its stated the claimant must respond within 28 days or the claim will be stayed. Does this apply to this claim since it has now been over 28 days? or does this name issue prevent this from happening?

    When the CCBC receive your defence, they send it to the claimant.  Once the claimant receives it, they THEN have 28 days to confirm that they are going to proceed not 28 days from when CCBC received it.

    Ah. I suppose we'll never know when they've received it. So it's just a case of waiting to see if it gets proceeded.

    Yes.  Reply to Gladstones with proof of your full name (maybe your V5C if you still own that car, or a Bank statement) but...
