Landlords job to paint interior or Tennants

    OIDIA, I think you need to get it clear in your head what is your responsibility, and what is the LL's. 

    IF the connie was mouldy when you moved in, that's the LL's responsibility. Once you have moved in, keeping it clean is yours. 

    IF the gutters were overflowing when you moved in, that's the LL's responsibility. Once you have moved in, keeping it clear and free-flowing is yours. In fact, if you fail to do this and the overflowing water causes damage to the house, you could be held liable.

    IF the walls were nicotine stained when you moved in, that's the LL's responsibility. Once you have moved in, yougettheidea?

    If these issues were present when you moved in - and the poor paintwork certainly seems to have been, then you should have made that an issue at the time. It seems, tho', you don't have a proper inventory? And a LL who is renting out the place whilst telling his insurance company he's living there? (How do you know this?)

    If you want to keep living there, then you need to check you have an annual Gas Safety Cert at the very least. You should also have a cert showing where your deposit is kept. You should also have T&Cs about renting (and I don't know what else LLs are meant to give). You should also ask for a copy of the inventory. Do you have any of this?!

    You can ask about him supplying paint, but I wouldn't hold out much hope. It's up to you what you then do - either go on to paint it yourself so you have a nicer place to live in, or live with the nicotine walls, or move.

    If you move, expect hassle from this guy about your deposit - unless you can demonstrate you are leaving the flat in the same condition as you moved in.

    Im getting your point....  i should have mentioned it at the time but i was so relieved to find somewhere to live  as my circumstances had drastically changed  i remember on viewing  there was a bottle of mould remover in the kitchen and the lino was rippling up in the middle he said he was going to change it then changed his mind told me to cover it over.
    As i moved in in the summer didnt hear the drip for months but when i did i made sure he knew about it he just classed as me moaning.
    I had my boiler serviced this morning thou i have been putting it off until they contacted my landlord i just felt i was put in a position  i dont like lying and i shouldnt have to,  my landlord wasnt happy with me when i told him 
    I think next year I'll look for somewhere to buy

    You say you have been in the property for 18 months. Did you receive a gas safety cert when you moved in? If so how old was it?
    Did you receive a how to rent booklet? an EPC certificate? Copy of any inventory? Any PAT certs relating to any electrical appliancies that the landlord is responsible for? Deposit scheme cert for the deposit you gave him? The tenants copy of the TA?

    As a landlord myself this guy is a bit of a joke and he needs to be taken to task for the way he is running things

    Well the good news is that provided you keep paying the rent he can never evict you. Any S21 Notice he serves will be invalid.

    Just as i thought  the landlord left an extra page in the TDS document,  i don't think he realised, stating this is a template document  it hasnt been drafted to meet individual requirements, i did wonder why it said ' delete where applicable ' guess he got a freebie

    Well the good news is that provided you keep paying the rent he can never evict you. Any S21 Notice he serves will be invalid.

    I think he would do  verbal notice  wouldnt think to do an S21 but good news he cant evict me

    Meanwhile, get out of the connie and stop wasting electricity! (Why are you doing that?!) On sunless days when the connie is not fit for being in, just crack open at least two windows in there to allow a through-draught and shut the doors between it and the house. If you leave the connie without ventilation, it will become mouldy. But don't let the warm moist air of the flat get in to it. And please don't run any heaters in there :-(

    Then take stock of your situation. Clearly you do not have an ideal LL. But, how much this should concerns you is your call - it might have some positives as mentioned before (he seemingly can't chuck you out!).

    Are you happy in your home? Is it good value? Are you paying less for this than you wouldn't for an alternative? If the answers are yes, yes and yes, then - if I were in your position - I would scrub the kitchen walls and give it 3 coats of a proper 'kitchen' paint of your own choice of colour. I personally wouldn't run this past the LL first; it seems clear from what you've said that he's also pleased to have you as his tenant. If he visits to carry out an inspection at any point, he'll find a much nicer place than he handed over to you (and you'll have 'before and after' photos to prove this). If he was looking for an excuse to evict you - which he almost certainly isn't - then let's see him take "She redecorated my nicotine-stained walls against my wishes" to court. 

    If the gutter is leaking due to a faulty joint - which it probably is - then inform your LL as it's his job to sort. Then forget about it - if the sponge works...

    Hi jeepers  the LL did write it down on the TDS and the ASTA but as  these documents have just been printed off the net  are they still a legal document  i didnt get a receipt for the deposit which was cash.
    I was heating the conservatory  landlord suggested when i complained that my documents are getting damp i have got my freezer out in the conservatory  not sure if thats not helping with the mould.
    How i see its a roof over my head albeit temporary  ( i certainly don't  want to be renting for ever)  specially at this time with the pandemic  ......am i happy ... not particularly  living here has effected my health  ..i dont have a sofa to sit on  i just wouldn't  fit one  in,   bed comes in handy as its the most comfy thing i got  so sleep an eat on it  so i can't invite people round theres just no room.
    I think he would like me to paint it  it would be a freebie  in his eyes,  he pops round just to pick his money up so I'll ask again about the gutter.
    Just out of curiosity would you share your Internet with other tenants in building i was asked by LL if i would do this

    but as  these documents have just been printed off the net  are they still a legal document
    which 'documents'? The AST? Yes it's valid. The deposit PI? Sounds like not. See sample PI below.

    It might ideed be helping. It will be chucking out (modest) heat from the rear. That's why it is cold inside!

    That's a matter between you and them. Some people save money by doing this. Be careful with eg online banking etc if others are using your internet (or vice verse).

  • Lordie - in this case the cons surely hugely outweigh any pros (which I'm struggling to find).

    Based on what you say, I would look to move out asap. Until then, I'd do zero to help this LL. I also wouldn't share my internet for all sorts of reasons - potential lack of security, risk of exceeding 'fair usage' by your provider and hence ending up with larger bills, almost certainly a slower service if others stream movies and stuff, and - well - why should you?; he's offered you b-all. 

    If you MUST store docs in the connie, then keep them away from the walls and also keep the place well ventilated. Yes it'll be cold, but that's the driest you'll get it without running up crazy bills. No, I don't think your freezer being out there is a problem (as long as your freezer doesn't mind*). 

    *Counter-intuitively, fridges and freezers can fail to work if they are in a too-cold room! They cannot expel they heat taken from inside the unit.
