    Redx its a letter before County Court Claim sent by Parking Eye on November 18th which has a Reply Form included. Do I print off the N1 form from Gov.uk and fill it out and send it off?

    No, you submit it on line.  Instructions for doing this are included in the NEWBIE sticky via a link.  There should be a log-in and password for your Government Gateway account to let you do this.  Is that date (November 18th) the ISSUE date as printed on the N1 claim form?  If so, @KeithP will be along to give you some deadlines for submitting the AoS and your defence.

    So it's an LBC and gives 30 days notice and includes financial forms too

    So it is not a County Court claim form so it's only the LBC advice you need at the moment , not court claim assistance so no , do not download or fill in any N1 form

    If you do not pay the £100 within that 30 days , Parking Eye will issue a court claim pack from the CCBC in Northampton , a proper Court claim , which will be for £175

    Personally I do not believe you have the nous to defend a court claim , nothing personal but your grasp of the situation is not up to scratch , perhaps it's learning difficulties ? I don't know

    What I do know is they offered the chance to pay £60 , it's now at £100 and a court claim pack will be for £175

    The choice is yours to make as your partner says , but if you continue to fight you need suitable help from somebody better qualified to assist you

    Court is not for everyone

    Redx! Not learning difficulties, just a clean slate never having been on the wrong side of the law before! And of an age and social standing that means I am a little flummoxed by technology and legal jargon! But thank you for your advise!

    As I have said previously I'm not contesting that I did stay on Town Quay 5 minutes longer than the 15 minute free parking, but wouldn't have done so if Red Funnel had told us about the technical difficulties resulting in the late arrival of the Redjet by 20 minutes. I just feel its an injustice to have to pay £60/100 for 5 minutes additional parking? Or should I just pay the £100?

    If you feel so strongly about it then put your case to a judge , in Court , if you lose in Court you can pay £175 to parking Eye , you pay nothing if you win in court , that is the risk assessment

    You are not on the wrong side of the law now , no laws were broken , it's breach of contract , a civil matter , not a criminal matter

    I have never had a private parking charge or been to court , but I have 7 years experience behind me on here

    At the moment I do not believe that you have a court claim pack from the CCBC in Northampton

    I believe that you have an LBC from Parking Eye , not paying the £100 will mean a Court claim of £175 coming from the CCBC in Northampton

    The choice you have is either pay £100 now ,or go to court next year and plead your case to a judge

    Those are your 2 choices at the moment

    Le_Kirk, the letter I have received from Parking Eye is a Letter Before County Court Claim dated the 18th of November. It includes a reply form. The first I've heard of a N1 AOS is today when I was advised on the forum that I needed to file a AOS within 18 days of receiving the LBCCC from Parking Eye?

    You confused us with your wording , which is why I realised you had an lbccc , not a court claim
    Plus you did not paragraph your initial post , making it much harder to read and to extract the facts

    No, its a "letter before county court claim" dated November 18th, sent by Parking Eye with a reply form which they have said needs to be sent back within 30 days from the 18th. Are you still advising me to pay up Redx?
    Will I not have to fill out the N1 AOS until it is an actual County Court Claim? Do I literally do nothing with the reply form from the LBCCC? Just sit and await my impending doom!

    Currently this has nothing to do with the CCBC in Northampton

    I am not advising you at all in what to do, that is not our job

    I am giving you advice on your current situation

    You either pay the £100 or you ignore the lbccc

    If you ignore the lbccc , you will receive a court claim pack from the CCBC in Northampton for a total of £175

    If that happens you either pay the £175 or you defend the claim and go to court next year

    So you have choices to make , with consequences at each stage

    I am outlining the facts , the decision is yours based on better knowledge of the facts
