I desperately need advice please?
i have read through the newbies section and I’m getting confused over the abbreviations !!!! Evidently not as intelligent as all you lovely knowledgeable people! I received a PCN from ParkingEye on September 8th. I’d gone to pick up my disabled mum from the redjet terminal at town quay Southamton on September 3rd, at 10.40am, the sailing was due to get in at 10.40, and they allow you 15 minutes free parking. There were about 7 other vehicles sat patiently waiting, so no doubt they’ve been stung by PE too! I hadn’t realised but we left town quay at 11am as mum explained when she got in the car that the engine had conked out leading to them docking 20 minutes late! No announcement over the tannoy was made by red funnel! If it had made us aware of the issues then I would have left and come back, or paid £2.50 for an hours parking!
I appealed to PE including a statement from red funnel confirming the delayed arrival. First stupid error from reading your advice was to inform them that it was me driving rather than my husband ( registered keeper), second mistake was receiving a second PCN on September 24th and ignoring it as I thought they had t responded to my appeal! Low and behold! They had rejected my appeal immediately and I’d totally missed the email! Last mistake I hope🤞Is I didn’t appeal to POPLA! As I didn’t know PE had rejected my appeal, so I missed the deadline to appeal to them! I have now received a county court letter from parkingeye! I have 30 days to send it back with the reply form stating whether I accept the debt etc! It was posted in November 18th. I’ve had a nightmare even trying to find out how to post a thread on this forum, and i’ve struggled to understand from all your previous advice as to what I should do next? It grieves me no end that companies like PE prey on innocent people and take advantage of frightening them into paying up! It’s shocking that they can get away with it! I want to fight them, but feel ill equipped! If they had charged me £30 for the 5 minutes over run I probably would have paid it? But £60/100?!!!! Daylight robbery! Makes me want to go down to town quay pay for an hours parking £2.50 I think? And then leave after 5 minutes and demand £100 back from them! I also tried to find the landowner of town quay to contact them, but can’t find it? To be honest I don’t even know where to start? Please can someone point me in the right direction? I’d be most grateful.

The main question at this stage is - have you acknowledged service of the claim (AOS) and without entering anything into the defence box?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You see this is where I'm already panicking! I have no idea what you're referring to Umkomaas? I have done nothing at all with the County Court Claim Form! The only correspondence PE have had from me was my initial appeal, I did stupidly admit it was me driving, and I did confirm that I had gone 5 minutes over the free parking because of the delayed sailing arriving 20 minutes late. I'm not too sure if thats what you mean?0

You must acknowledge service (referred to on the forum - in shorthand - as AOS) of the N1 claim within 19 days of its issue date, otherwise you lose automatically and get a CCJ against you. The NEWBIES FAQ sticky, second post, contains step by step help in what you need to do. It is far too detailed to type out and repeat to every person who comes to the forum - hundreds a month - with a court claim.Please note, we are not a legal advice forum. Stop panicking , login to the MCOL website and do the AOS today !!
Do not do anything else on that website , just the acknowledgement only
If you have not done a SAR yet , email a SAR to the DPO at Parking Eye attaching a copy of the claim form to it as proof of I D under the GDPR law , to obtain all your data
KeithP will probably reply with your deadlines but it's not that 30 days you mentioned , it's 33 days from the issue date , providing you do that AOS ASAP , preferably today3 -
Umkomaas, I have gone back on the Newbies section and still cant see no mention of the AOS of N1 Claim? Is this the reply form provided with the LBCCC? Do you genuinely feel that I will win? Or should I just go pay the £100? I'm already stressing over my inability to understand what I'm supposed to do? And my Husband is telling me to just pay and make it go away!0

This is nothing to do with the lbccc , unless that is the letter you received ?
It's either an lbccc with 30 days notice , or it's a claim form from the CCBC in Northampton ?
The second post in that thread tells you how to do the AOS online in order to assist you
Parking Eye won't accept £100 because the court claim is £175 , the time to pay £100 has expired,
