The car park is a beach car park, I've found the owner and sent them an email.

I'm off to gather some evidence at the weekend too, the car park only started using Excel 2 weeks before my offence. It use to be an honesty jar before that.

I'm guessing I'll need as much information as possible because I'm fully expecting to go to court after what I've read about Excel.
So this ruthless landowner used to favour an honesty jar?  Interesting!  I hope they prove to be understanding and helpful.

I reckon PPCs target car parks with honesty jars.  I won't say any more but you can imagine what problems a dishonest PPC could cause in a car park to create an issue that they can - hey presto - address.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • The land owner replied and was very unsympathetic and rude, he will not help. He said I need to take it up with Excel.
When it goes to court and I try and claim costs, will that be against Excel or against the land owner. He's really rattled me and I want to go after him.

Your costs are against the claimant , Excel , not the landowner

You can put in a counter claim with your defence against the claimant and conjoin the landowner into it because they are jointly and severally liable along with their contractor

Yep, to involve the landowner you sue the landowner.
They hire excel, if excel do something actionable , you can sue the principal. Google law of agency.
  • Will do, thanks guys.

Perhaps the landowner is now regretting his decision of employing a PPC.

Excel are a very litigous company and they will either pursue the case through the courts or take it to the brink and pull at the last minute. They are beatable and the reps that they employ are not well briefed beforehand. That gives the defendant an advantage.
