Hello all,
Great forum and thanks for all the information.
I got a NTK from Excel, but it arrived after 14 days. On all the posts I have seen about Excel, all of them say that Excel does not include POFA on there letters. They did on mine, they didn't mention POFA directly but said they will pursue the keeper if I cannot name the driver in 28 days.
Am I right in saying they cannot do this as they were late in sending the NTK?

If they failed to comply with POFA , as is usual , the keeper has no liability in law but they will revert to assuming that the keeper was the driver , so they will proceed on that assumption
A landowner cancellation is the best option for you , it always is , so plan A4 -
You are right but this will not get it cancelled on appeal. There is no independent appeal. Excel cases are won later, in court.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I do not know who the land owner is.
When I first got the letter, I wrote to them and told them that I was not the driver and I do not have to tell them who the driver was and I would be appealing the fine.
In the email I also asked who the land owner was and if they had it in writing that they can issue parking tickets on that piece of land.
They just replied telling me to follow the appeals process and as a 'favour or goodwill they will extend the 2 week period to pay at a reduced rate haha.
After reading all the posts on here I know this appeal and the IAS appeal will get turned down, I guess I'll just have to see them I court then!

Very few people who come here know who owns or manages a car park. But you can find out ... try googling the car park and the premises it serves. Sometimes a store owns the land, more often there's an overall landowner or land management agent who is responsible for it and who engaged the parking cowboys.Chedder_Chad said:I do not know who the land owner is.
There are often hints in small print - look for what sounds like a big company. Alternatively phone neighbouring premises and simply ask them, sometimes they can be helpful. Another route is to pay a small fee to Land Registry for this information, I believe it's less than a fiver.
It's very often worth the effort.3 -

Don't know weather its true or not but I gave up hope of appealing the them after that lol0 -
I read that london buses where pink , so I asked , in your case why not follow advice and ask neighbouring buisnesses or blow £3 at land registryChedder_Chad said:Hi,

If the owner is locking the gates with cars inside, he is breaking the law. That sort of activity was outlawed along with clamping by the introduction of the PoFA in 2012.

Locking the gate is fine if the gate is normally locked at a certain time. That has not been outlawed.1

The car park is a beach car park, I've found the owner and sent them an email.
I'm off to gather some evidence at the weekend too, the car park only started using Excel 2 weeks before my offence. It use to be an honesty jar before that.
I'm guessing I'll need as much information as possible because I'm fully expecting to go to court after what I've read about Excel.4
