I paid £500 deposit at a distance. £500 agreed as part ex distanced and then the balance at the dealership.0

OK, in which case anything the dealer does now for you is purely down to goodwill on their part. You have no legal right to a refund within 14 days as this was not a distance sale. If it was an approved used Mercedes, a swap is normally allowed within a month provided no more than 1000 miles have been covered. Nothing in the Approved Used promise that allows a refund though, just an exchange.0

Really , it boils down to this:
These threads always start with "what are my rights?" and an approach to the dealer from that starting point is always going to be starting off from an aggressive tone (whether intentionally or not) and the better outcome is more likely to be achieved by making a friendly request to the dealer. It now seems as though the OP has a reasonable "next step" with Mercedes:
I would counter that, with any "new" car is going to feel different to an "old" car. Anyway ive spoken to dealership and agreeed I am going to give it a few more days. They seem to be keen to help resolve it even if i swap for a different Merc.

If you think you're going to find it hard to adapt to a different car, then test-drive for longer pre-purchase.0
