  • Thank you for your reply to the County Court claim.

Your reply is being returned to you as it was received outside the 19 days permitted and Judgment has been entered against you. If you think that a Judgment has been entered against you incorrectly and you would like to remove it, you can apply to set the Judgment aside using the N244 ‘Application Notice’. As the Claimant has issued a Writ of Control to enforce the Judgment you will also need to request to ‘stay the writ’ on the same N244. Please read this letter and the enclosed notes thoroughly before sending the application to the court as incorrectly completed applications will be returned to you.

Electronic versions of all forms referred to in this letter e.g. N244 ‘Application Notice’, are available to download at www.justice.gov.uk/forms. When returning your application please provide one copy of the application for each defendant, one copy for the claimant and one copy for the court.

If you are having problems completing an electronic form please visit the following link, it contains useful information about using Adobe which may be of assistance. https://acrobat.adobe.com/uk/en/products/about-adobe-pdf.html

There is a £255.00 court fee to process the application, payable by cheque or postal order to HMCTS. If you cannot afford to pay this fee you can check if you are eligible for help with court fees by referring to the EX160 Help with fees form and EX160A Help with fees guidance, which can be downloaded at www.justice.gov.uk/forms or provided on request.

Please note, applications to stay the writ and set the Judgment aside are not automatically granted. The outcome of your applications is at the discretion of a Deputy District Judge or a court appointed Legal Advisor.

If you have already paid the application fee you can file the completed forms via email at ccbcfees@justice.gov.uk. Card payments for application fees can be taken by contacting the Helpdesk on the above number between 9.30 and 3.30, Monday – Friday.

If you require any further information, please contact our helpdesk on the number below. Alternatively, you can email us at ccbc@justice.gov.uk; Please ensure that you state the above case number in the subject heading of your email. You may also find it useful to visit the frequently asked questions (FAQ’s) section of our website. To locate this page you should go to www.justice.gov.uk and search for ‘CCBC’.

    BAILIFFS.  YOU ARE TOO LATE.

Are you sure that you put the right claim number on this, not the other one?  Ring up the CCBC and say you believe the C had only enforced the other claim, not this one.
