URBAN EXCHANGE-HIGHVIEW PARKING- DCBL LEGAL-PLEASE HELP

Hi All, 
I have been following this thread since 2017. As everyone, I was mislead by the sign and parked upto 2 hours each time I went to the gym. 

Received a ticket and paid without thinking. Then began to receive more and more tickets, and even for a car that was not mine. After doing my research I ignored.

I then started to receive DCBL notice of recovery letters- I ignored. 

Then received a DCB legal letter of claim- i ignored (12th June 2020)

And now receiving claim forms- (5th Oct). 

Please help really worried as live and look after elderly parents with heart conditions. I worry they may turn up when I am not at home and scare my parents.

    What happened when you complained to the landowner and gym manager? It's still not too late to tell the gym you will cease to be a member. Businesses want all the customers they can get right now.

    The advice to ignore a PCN has not been given here since the law changed in 2012, so I have no idea where you saw anything to the contrary.

    Ignoring DCBL was correct as debt collectors have no powers.

    Ignoring DCB Legal and a Letter of Claim was a bad idea. Depending on what you actually received on the 5th of October, it may be too late for you to do anything. 
    You need to be more specific, and get your head out of the sand. What precisely have you received and from whom?

    Nobody can come knocking on anyone's door unless they have been to court, lost, failed to pay within the timescales given by the court such that the claimant has engaged court appointed bailiffs. However, if a court claim was issued back in October and you didn't acknowledge service then all of the above may have happened without you knowing it.

    Have you kept any of the documents sent to you, especially anything for the car that wasn't yours?

    You are thinking, wrongly, that this is DCBL acting as bailiffs.

    It is NOT bailiffs coming round (unless you ignore a claim and fail to defend or fail to follow court letter Directions).  It is not at bailiff stage, despite the 'CAN'T PAY, WE'LL TAKE IT AWAY' logo on the tedious letters. Yawn.

    Do you have actual N1 court CLAIM FORMS (plural)?  
    How many CLAIMS FORMS?
    WHAT IS THE ISSUE DATE OF EACH CLAIM?
    ARE ANY OF THEM FOR A CAR YOU HAVE NEVER OWNED?

    Or is it just the tedious pre-court 'threat' letters, in which case adapt the reply I wrote for DCBLegal in the thread by @Minotaur4 which he adapted to see off BW Legal.  But earlier in his thread (NO LINK, OBVIOUSLY!) I showed a version I'd used for DCBLegal from February, to which no response has ever come back!

    Clearly if you have actual Claim Forms it's too late for that letter but YOU MUST DEFEND THE CLAIMS.

    Yes, the letters are headed claim form and yes from the Northampton CBBC. 
    How many - and please give the Issue Date for each?

    I have received 2 separate claim form from the Northampton CBBC, as one letter is in regard to my actual car ( £946), and another claim form for a reg plate that is not mine (£279) . Both letters were sent on the 5th Oct. 

    I ignored, and then received a letter headed 'judgment for claimant' again from the Northampton CBBC on the 28th Oct.

    I have tried to contact the landowner everytime I call the urban exchange the receptionist has said they can't cancel the ticket and she doesn't know why I think they can. She said I have to contact the number on the high view parking ticket. I explained that people have had their tickets dropped and she became rather due and hung up on me. In terms of the gym manager I contacted them as soon as I received the fines in 2017, they said they don't deal with it as it is a separate entity. I cancelled my membership back in 2017.

    Oh my bad :/ I must have mis understood. I actually had moved out of the country to Dubai when the tickets were being sent in 2017.

    2017- I received the parking fines from high view ( I do not have the letters anymore). for my car and a car not mine. 

    12/Dec/20- Notice of enforcement from DCBL. sum of £1180 to be paid by 25th Dec 2020. 

    19/March/20- Notice of Debt Recovery from DCBL-  x4 for my car a sum of £165 
                                                                                           x1 for a unknown car of £165
    12/June/20- Letter of Claim- from DCBL Legal - x1 for my reg -£660
                                                                                x1 for unknown reg- £165 
    5/OCT/20- Claim form- Northampton CCBC- X1 - TOTAL £946.61
                                                                             x1 - total £279.39
    28/oct/20- Judgment for claimant-  must pay 205.27 + £97 for costs= total £302.27. 

    I can send you copies of the letters if more helpful.

    Yes the letters mentioned above I have, and it mentions the reg plate which is not mine. I do not have the original parking fine letters with the pictures of the cars. However, I remember the unknown reg was a A class mercedez.

     I have ignored the court letters unfortunately from Oct.

    No only one, sent on 5th Oct ( 1 for my car, 1 for unknown reg), after that it was a judgment for claimant letter on 28th oct.

    What a mess.

    With a Claim Issue Date of 5th October, you had until Monday 26th October to either file an Acknowledgment of Service or file a Defence. 

    As you failed to do that the Claimant has been able to request a Judgment by Default.

    You now need to pay the amount specified on the Judgment to the Claimant within the timescale stated.

    OMG you ignored court claim forms, including about a car that had nothing to do with you?  And now you have at least one CCJ as a result.

    I reverse my previous advice. 
    You have mucked up, and you are at risk of bailiffs now.   You are going to have to pay the £302.27 one IN FULL or your credit rating is ruined for six years.

    28/oct/20- Judgment for claimant-  must pay 205.27 + £97 for costs= total £302.27. 
    You are about to get another one of those for near enough a thousand pounds...for the other claim that you ignored.

    The only thing I can suggest is that you bung in a signed & dated defence for the £900+ one today RIGHT NOW, by email to the CCBC with 'URGENT' and the RIGHT Claim number for the £900 one in the subject line, and hope DCBLegal have forgotten to apply for judgment for that one yet.  You know how to do a defence, it takes just an hour (max) by using our template defence., Could not have been easier.

    If I were you I would add a counterclaim for harassment and data misuse resulting in an actual £302.97 loss (the one you've been forced to pay) given that the Claimant misused your keeper data and attributed it to a car that has nothing to do with you *.

    Ignoring claim forms is stupid. 
    You just have to hope they have not yet applied for a default judgement for the larger amount. You MUST send a defence in NOW.  No delays. No asking questions. NOW
